📢 An Unprecedented Collapse of the Rule of Law: Crimes Against Humanity Through the Judiciary in Full View of Europe
On 16 December 2025, the European Court of Human Rights (@ECHR_CEDH), in three group judgments continuing the #Yalçınkaya and #Demirhan line of case-law, found new violations of the right to a fair trial (Article 6 of ECHR) and the principle of legality (Article 7 of #ECHR) in respect of 2,420 applicants.
📌 As a result:
The Yalçınkaya and Demirhan group judgments now concern
A total of 2,659 individuals whose criminal convictions were found by the Court to be contrary to fundamental Convention standards.
📌 Yet these judgments represent only the tip of the iceberg.
🔎 According to official data analysed by independent experts, since the controversial coup attempt of July 2016,
📍 approximately 3,093,084 individuals — nearly 4% of Türkiye’s population
📍 have been subjected to terrorism-related accusations, investigations, prosecutions or convictions.
❗ No credible security rationale,
❗ no democratic rule-of-law justification, can explain or legitimize such a massive criminalisation of a population.
This scale alone demonstrates:
⚠️ Systemic arbitrariness,
⚠️ The instrumentalisation of criminal law as a tool of repression,
⚠️ The subordination of the judiciary to political objectives.
📌 The ECtHR has expressly confirmed this reality:
In 55 separate judgments,
Concerning 3,967 applicants,
The Court found violations relating to unlawful and arbitrary detention.
1,239 of these victims were judges and prosecutors.
📌 In its landmark Yalçınkaya v. Türkiye judgment, the Court stated unambiguously:
“The situation that led to a finding of violations was not prompted by an isolated incident, but stemmed from a systemic problem, which has affected — and remains capable of affecting — a great number of persons.” (para. 114)
📌 Today:
More than 10,000 applications raising similar complaints are pending before the ECtHR.
The Court has already communicated approximately 9,800 of these cases to the Turkish Government, without requesting observations on the merits, clearly indicating that it considers the underlying legal issues to be settled by its established case-law.
Thousands of individuals remain imprisoned on the basis of convictions already found by the Court to be contrary to Articles 6 and 7 of the Convention.
Tens of thousands of families have been irreparably harmed by years of arbitrary prosecutions, convictions and imprisonment.
❗ Most alarmingly, despite the ECtHR’s clear and repeated findings, individuals continue to be arrested, prosecuted and convicted on a daily basis in Türkiye, under the same legal framework, the same evidentiary standards, and the same judicial practices that the Court has already declared incompatible with the Convention.
🚨 URGENT CALL
The continued enforcement of a judicial system that the European Court of Human Rights has repeatedly and unequivocally found to be unlawful can no longer be tolerated.
Every new arrest, every new prosecution, and every new conviction issued under this discredited legal framework constitutes a deliberate continuation of a system of violations, carried out in full knowledge of its illegality.
⚠️ This is no longer a matter of legal error or delayed reform.
⚠️ It is the conscious perpetuation of systemic injustice.
The @UN_HRC, @coe, its Member States, and all international human rights mechanisms (@UN_SPExperts @UNHumanRights) now face a clear choice:
Act decisively to halt these violations, or
Accept responsibility for their continuation through inaction.
⚖️ The rule of law cannot be deferred.
🕊️ Justice cannot be negotiated.
🌍 Europe must act—now.
