"totally oatsome" is extremely hard to find on images of oatly's products. the complaint includes this image that oatly sent oatsome, which does not look remotely like "use as a mark" to me. go ahead & look for it among all the text--it may take a minute. #failuretofunction
i argued in #failuretofunction that the context of the TM use as reflected in the specimen submitted to @uspto must be scrutinized to predict whether consumers will actually perceive matter as a mark. but assignability does throw a wrench in-- new owner must also use as a mark.

FOX Media's trademark application for 'OK BOOMER' has been denied by the USPTO.
The USPTO found that 'OK BOOMER' is a "widely used common place message" and incapable of functioning as a trademark.
The refusal was just issued yesterday, February 4th.
