🤔 જો કે સવાલ એ છે કે આ #પ્રશ્નો_રદ_કરવામાં_કેમ_આવ્યા ? જ્યારે ઓપ્શનમાં સાચા જવાબો હાજર હતા અને ખુદ AMC ની જ અધિકૃત કાયદાની પુસ્તક "ગુજરાત પ્રોવેન્સિયલ મ્યુનિસિપલ કોર્પોરેશન એક્ટ 1949" માં તેના પુરાવા છે! 🤔

🛑૧. પ્રશ્ન ક્રમાંક 089 (વેરા પેટે લેણી રકમ માંડવાળ કરવાની સત્તા)
કાયદાકીય તથ્ય: GPMC Act ની કલમ 152 ("Writing off of irrecoverable taxes") માં સાફ શબ્દોમાં લખ્યું છે કે – "The Commissioner may, with the approval of the Standing Committee, from time to time write off..."
◾વાસ્તવિકતા: પ્રશ્નપત્રમાં વિકલ્પ (D) "સ્ટેન્ડીંગ કમિટીની મંજૂરી બાદ કમિશનરને" એકદમ સ્પષ્ટ અને સાચો જવાબ આપ્યો જ હતો.
◽સવાલ: જો કાયદાની કલમ અને ઓપ્શન બંને ૧૦૦% મેચ થતા હોય, તો કયા તર્કના આધારે આ પ્રશ્ન રદ કરાયો ❓
🛑૨. પ્રશ્ન ક્રમાંક 100 (રી-ડેવલપમેન્ટ વિસ્તાર જાહેર કરવા માટેનું અયોગ્ય કારણ)
એક્ટની કલમ 284E મુજબ રી-ડેવલપમેન્ટ માટે (a), (b) અને (c) એમ ત્રણ કાયદેસરના ગ્રાઉન્ડ આપેલા છે.
◾વાસ્તવિકતા: વિકલ્પ (C) "મેટ્રો શહેરની જોગવાઈઓ પરિપૂર્ણ કરવા માટે..." એવું કોઈ કારણ કાયદાના પુસ્તકમાં અસ્તિત્વ ધરાવતું જ નથી, એટલે કે પ્રશ્ન મુજબ તે જ સાચો જવાબ (Not a valid ground) બને છે.
◽સવાલ: કાયદાની જોગવાઈઓ સામે ઓપ્શન બિલકુલ સાચો હોવા છતાં ઉમેદવારોના સાચા માર્ક્સ કેમ કાપી નાખવામાં આવ્યા?
🛑૩. પ્રશ્ન ક્રમાંક 085 (મિલકત વેરાની બાકી રકમની વસૂલાતની મર્યાદા)
◾કાયદાકીય તથ્ય: કલમ 140(3) મુજબ – "which has remained due for more than one year..."
◽વાસ્તવિકતા: પ્રશ્નની મૂળ રકમ (Question Stem) ની અંદર જ "more than" / "થી વધુ" શબ્દોનો ઉલ્લેખ પહેલેથી જ કરી દેવામાં આવ્યો છે. જો આ શરત પ્રશ્નમાં જ આવી ગઈ હોય, તો ઓપ્શનમાં માત્ર સીધો જવાબ ('એક વર્ષ') આપ્યો હોય તો પણ તે ગણિત અને તર્કની દ્રષ્ટિએ સંપૂર્ણ સાચો જ ગણાય.
◾સવાલ: ઓપ્શનમાં સાચો જવાબ ઉપલબ્ધ છે જ, તેથી આ પ્રશ્ન રદ શા માટે ?
🛑૪. પ્રશ્ન ક્રમાંક 093 (બાંધકામ સામગ્રી હટાવવાની નોટિસનો સમયગાળો)
◽કાયદાકીય તથ્ય: કલમ 239(2) મુજબ કમિશનર દ્વારા ૨૪ કલાક ("not less than twenty-four hours") ની લેખિત નોટિસ આપવાની જોગવાઈ છે.
🧐 ઉમેદવારોનો AMC સત્તાધીશોને સીધો સવાલ છે:
❓ જો ખુદ કોર્પોરેશન પોતાના જ અધિકૃત 'GPMC Act' ના કાયદા પુસ્તકના આધારે સાચા પ્રશ્નો ઓળખી શકતું ન હોય, તો રાત-દિવસ એક કરીને કાયદો યાદ રાખનાર પ્રમાણિક ઉમેદવારોની મહેનતનું શું ?
❓ કોઈ પણ સ્પષ્ટતા કે કારણ આપ્યા વગર સીધા પ્રશ્નો રદ કરી દેવા એ હજારો ઉમેદવારોના ભવિષ્ય સાથે ચેડાં સમાન છે. આનાથી મેરિટ પર ગંભીર અસરો પડે છે અને અયોગ્ય તત્વો આગળ આવી જવાની ભીતિ રહે છે.
🧑🏻🏫સ્પર્ધાત્મક પરીક્ષામાં ૦.૨૫ માર્કસ માટે પણ ઉમેદવારો રાત-દિવસ એક કરતા હોય છે, ત્યારે ૪-૪ પ્રશ્નો ખોટી રીતે રદ થાય, તેની કિંમત એક મહેનતુ વિદ્યાર્થી જ સમજી શકે.
🧑🏻🏫જ્યારે કોઈ ઉમેદવારે કાયદાની બુક (GPMC Act) વાંચીને, એક-એક કલમ સમજીને સાચો જવાબ આપ્યો હોય અને ઓપ્શનમાં પણ એ જવાબ હાજર હોય, ત્યારે માત્ર વહીવટી અણઆવડત બહાને આખો પ્રશ્ન જ રદ કરી દેવો એ સીધેસીધો ન્યાયના સિદ્ધાંતોની વિરુદ્ધ છે.
🧑🏻🏫જે વિદ્યાર્થીએ મહેનત કરીને એ અઘરા પ્રશ્નો સાચા પડ્યા હતા, તે સીધો રેસમાંથી બહાર ફેંકાઈ જાય છે અને જેણે એ પ્રશ્નો છોડી દીધા હતા કે ખોટા પડ્યા હતા, તેને વગર મહેનતે ફાયદો થઈ જાય છે.
🙏🏻માનનીય મ્યુનિસિપલ કમિશનરશ્રી અને સ્ટાફ સિલેક્શન કમિટીને નમ્ર અપીલ છે કે આ ફાઇનલ આન્સર-કીનું પુનઃ મૂલ્યાંકન કરવામાં આવે અને વિદ્યાર્થીઓને ન્યાય મળે.
