Il caso #Kinsa, curato dallo studio Gamberini non solo al tribunale di Bologna ma anche in Corte Costituzionale e CGUE, una volta di più mette in mora 'filosofia' e torsioni arbitrarie nell'applicazione dell'art. 12 Testo Unico immigrazione: nato con legge Turco-Napolitano, poi aggravato con Bossi-Fini, poi aggravato da mille altre leggi non ultime quelle del governo Globoterracqueo Meloni-Piantedosi.
Sullo stesso caso la Corte Costituzionale⚖️🇮🇹 è già intervenuta nel 2022, dichiarando illegittime e manifestamente sproporzionate le pene previste per il favoreggiamento dell'immigrazione irregolare (ex art. 12) aggravate dall'utilizzo di mezzi di ordinari trasporto internazionali e documenti di identità falsi.

Oggi la Grande Sezione CGUE⚖️🇪🇺, in risposta al rinvio pervenuto dal giudicante di Bologna, taglia corto sul caso Kinsa: dichiarando che "il cittadino di un paese terzo che entra illegalmente nell'Unione europea non può essere sanzionato per favoreggiamento dell'ingresso illegale per il solo fatto di essere accompagnato dal figlio minorenne".

Nella parte del contesto normativo utilizzata per l'odierna sentenza, la Corte di Giustizia Europea non si ferma al solo diritto unionale ma mette in rilievo 'uber alles' i trattati ONU: Convenzione di Ginevra, Protocollo Palermo sul traffico migranti e - soprattutto - la Convenzione sui diritti del fanciullo.
Trattati ONU prima di tutto: stesso criterio normativo adottato dalla Corte Suprema Britannica⚖️🇬🇧 nel demolire il piano Ruanda che venne imbastito dal governo Sunak.
Considerati i tempi odierni segnati da improvvidi attori in preda al suprematismo elettorale, italiani inclusi, che vorrebbero perfino revisionare quei trattati ONU e CEDU - frutto di faticose e 'secolari' conquiste di civilità - direi che la sentenza resa nota oggi dalla Corte di Giustizia Europea assume un importante significato (osservare un minuto di silenzio per i retequattristi a vario totolo).
