If the $MMTLp community reads the SEC’s response to the motion to dismiss, it does paint an interesting story. And they didn’t even get to the $MMTLP issue - which is the very wide net of the #MMTLPdebacle that is likely the subject of the ongoing investigation. Interesting though, that the continuing narrative is shorts from TRCH to shorts to MMTLP. If TRCH was in fact short, naked or otherwise, that could be a substantial defense because then many of the statements made could be true. It’s not illegal to talk about a short squeeze or even develop a market strategy around that. Hedge funds do that all the time. But we know this is only the first lawsuit - and another one dealing directly with similar issues will likely be filed but dealing with MMTLP. Maybe the SEC will share their data on shorts on TRCH if the MTD is denied and the parties proceed to discovery. That could be one of the holy grails the community is pursuing.

It’s saddening to see someone that has a national platform to take a position and to provide an opinion on a security that he now obviously shows he knows nothing about. Many people use the “Pump and Dump” narrative to hide other anomalies in the market. While pumping and dumping does exist, it’s very hard to prove. This is why the SEC has not brought many enforcement actions against those who are claimed to have done so. Social media “pumping” is NOT illegal at all - and many public companies hire “IR” firms to promote investor awareness. It’s easy to accuse posters of pumping a stock - because their opinions are public record. And there are specific lines that can’t be crossed. However, in order to prove pumping and dumping you need specific facts on both sides of that claim including the “dumping”. Meaning the volume of an issuers shares activity will increase dues to the additional buying of the pump - then a precipitous drop when the dump (selling) comes. However, this same market activity can be attributable to shorting and naked shorting - and so far, with all the DD available - I can’t find the connection to change in volume and share price associated with a pump and dump scheme. I think it’s a big mistake to allege a “Pump and Dump” without the data to indicate it - and that’s exactly what @CGasparino is doing. Without any analysis to the trading activity, his claims are vague at best. I would expect a journalist to actually do the due diligence before taking a position. That’s what journalism use to be and that’s what he use to do. As far as the short/naked short and counterfeiting of the $MMTLP security, we have demonstrated with enough evidence, including the admissions by a small broker - they have an imbalance. However, if a seasoned journalist wishes to ignore one side of the facts ( seems more common to do so these days) and focus on what amounts to bare assertions, I rather get my news from the Enquirer or Mad Magazine.

Absent this, the dividends were effectively registered and free trading by default. I just wonder why SONSINI forgot to do that? The crack securities guys at the vaunted Sonsini
should have said, “Hey MMAT let’s make sure these SPECIAL DIVVY shares CANT trade.” this was a Big Ommision. Or was it ? They definitely SHOULDA said let’s also set an Ex-date this way there’s the drop dead date, easy for transfer agent. Every REORG department on the street WOULDA seen the ex date and RECALL all lent shares.
I’m just digging in but it is starting to appear to me that SONSINI was conflicted. THEY REPRESENT ANSON. SONSINI COULDA done a lot of things. But the question I’m trying to answer is did they drop the ball, to open a back door for their big client @Anson coincidentally a Canadian Toxic Funder who has settled multiple NAKED SHORT CASES with @SECGov
