It’s been a year since @USCIS agreed to reopen cases and consider new requests for #medicaldeferredaction — after quietly trying to eliminate the process.
Now, many across the country worry it’s one again under silent attack. https://t.co/JQbtUuX28Z
Attorneys @LegalHealthNY say some #medicaldeferredaction clients are receiving ‘notices to appear’ — triggering deportation proceedings and meaning severely ill risk showing up in #immigration court during a #pandemic.

Approval rates for #medicaldeferredaction are steadily declining under #Trump admin. @USCIS tried quietly dismantling the humanitarian policy last yr.

FY19: 411 requests, 28% approved
As of 5/20: 372 requests, 11% approved https://t.co/dc5K7b29du
In April, @SenMarkey, @SenWarren, @RepPressley, @SenBooker asked @USCIS for info on requests/ approvals of #medicaldeferredaction.

I’ve found myself managing a variety of different immigration cases as of late. Yesterday my attention was zeroed in on a #VisaExtension matter, while today I’m fielding a #MedicalDeferredAction case. #ImmigrationLaw can be tedious and confusing, but it keeps me on my toes.⚖️
.@SenMarkey @SenWarren and @RepPressley are demanding more info from @USCIS about it's re-opening of #medicaldeferredaction -- saying that "the U.S. cannot, in good conscience," return chronically ill people back to countries ill-equipped to care for them amid #COVID19 pandemic.
Now more than ever, we must ensure that sick immigrants who need treatment are able to remain in the US. @SenWarren, @RepPressley, @SenBooker, & I demand the Trump admin provide answers about whether it is granting deferred action requests during #COVID19.

.@SenMarkey @SenWarren @RepPressley and @SenBooker are pressing @USCIS for details about #medicaldeferredaction amid the #COVID19 pandemic.
"We fear that USCIS has renewed consideration of medical deferred action requests in name only," they write. https://t.co/PB9c8LUuab
And, after quietly eliminating the application process behind closed doors, the #Trump administration reinstated #MedicalDeferredAction as an option for some seriously ill #immigrants looking to stay in the U.S. for medical treatment:

This is truly good news, especially for those following this story. @EricTopol @MikeAndersonMD @UCSFBenioffOAK @UCSFChildrens @MAhealthforkids @DeannaMarie208 @tnicholsmd @pedsmd2b #MedicalDeferredAction
Isabel Bueso, a disabled Concord woman who gained national attention as she fought her deportation to Guatemala, will be allowed to stay in the U.S. for two more years, the family announced Monday: @sfchronicle https://t.co/7NdJxsI4DD
Jonathan Sanchez, 16, has cystic fibrosis. His family came to symbolize the fight for #MedicalDeferredAction.
In Aug, they were told to return to #Honduras or risk being deported. After congressional hearings, deferred action was reinstated.

UPDATE on #MedicalDeferredAction:
Jonathan Sanchez & his family will be able to remain in the U.S. for two years while he receives treatment for cystic fibrosis.
Dozens of others haven’t yet heard from USCIS which has @RepPressley & advocates concerned.

2/ The head of @AILANational's New England chapter — where news of the denial letters first broke — told me that out of at least 40 cases in that region, to date, only two have been approved since the summer controversy.

@BostonGlobe @WhiteHouse While she’s at the BMC, would love to get her feelings on the decision to end #medicaldeferredaction for #immigrant children, or is she not aware of her husband’s administration’s monstrous decision?
ICYMI - @USCISCuccinelli admitted this week that he was responsible for the cruel & callous decision to terminate #MedicalDeferredAction, risking the lives of hundreds of critically ill migrant children for no reason other than his own xenophobia. https://t.co/gAYQMTTZir
Totally spitballing here but I wonder what Trump thought of Cuccinelli’s (on the whole) mild testimony Wed re ending #MedicalDeferredAction...
(Which included Cuccinelli saying he would have done things differently, and wouldn’t have applied the change to pending applications.
For months, Acting USCIS Director Ken Cuccinelli has gone on Fox to constantly praise the president, toured the border with other agencies, & commented on ICE/CBP affairs on Twitter.
To many, it was clear he wanted the DHS Secretary gig.
In the end, he didn't get it.
He actually said he regrets applying the policy retroactively, which is quite different than saying he regrets ending the process of #MedicalDeferredAction.
@RepPressley took the time to not only provide my #littlelobbyists with a treat but to also listened to us about our the need to #ProtectPreExistingConditions. We thanked her for her work in #MedicalDeferredAction.

While today's hearing provided some clarity into the ending -- and subsequent reinstatement -- of #MedicalDeferredAction, it remains unclear when families with pending applications will receive approvals or denials.
