"My thought was, if I do ketamine again, maybe I will pass out. My thought was that if I passed out and these men have sex with me, then they could have been charged with rape at this point."

Days after the event, she texted one of the accused men explicitly stating that "none of the sexual stuff was illegal" and commiserating about campus rumors ruining reputations.
The Legal Reality
When a complainant’s contemporaneous statements admit to voluntary encounters, state that nothing illegal occurred, and describe intentionally taking drugs to create a scenario where charges could be brought, no prosecutor in the country can secure a felony rape conviction beyond a reasonable doubt.

Start at the door, since that is where he put the incapacity. “She didn’t have consent from the time she walked in. She was incapable of consent.” The complaint says she stumbled in around 11 p.m. after about ten drinks. Her own November statement, as the @NewYorker and @NBCNews reported it, says she was pretty okay with the first threesome, oral and vaginal, with two men she knew.
@LegalSunny, reading the nine pages, said two agreed threesomes and three of the seven never touched her. The district attorney said that statement described the sex and the drugs as voluntary, conscious, and consensual, and did not allege a gang rape or ketamine forced on her.
A woman who is incapable from the threshold does not get to be pretty okay with a threesome in her own words. He needs the door to be the end of her agency. Her statement keeps agency in the room for hours. The ragdoll is the same collision. He says ketamine left her floating above herself, shuffled like a sex worker, unable to stop it, and he points at the Title IX transcript.
In that same investigative file she tells police she thought about taking ketamine again so she might pass out, because if she passed out and they had sex they could be charged with rape. That is a person making a legal calculation in the middle of the night she now calls a blackout. People dissociate and still have a thought. They do not, on this record, also send a coherent “not sure” to a roommate at 3:09, an hour and a half after the chat, and then walk home at 11:15 in the boots and the dress and report sex with multiple men without the word rape. The floating is his gloss. The phone is hers.
The smoking gun is a chat, and he knows it, because he narrows it. A screengrab at 1:42 a.m. advertises a woman upstairs for free sex, to a group of dozens.
“Not one of those 50 men did anything to stop it.” Fifty men saw a disgusting message. That makes fifty witnesses to a sentence. It does not make fifty participants, and it does not make seven rapists. One accused man’s lawyer has already said his client went in, she was not undressed, she was not in distress, and he left. @CBS has her smiling in a photo the chat passed around, sandwiched between “whip it out” and “shop still open.” The smile is not a waiver. The chat is not a roll call.
Then Giuffra says the quiet part: four of the seven are specifically accused of rape. “They’re not all gang rapists. They’re all sexual abusers, though.” That is @LegalSunny's number, arriving from the other side. The caption sued seven. The lawyer now charges four with rape and keeps the other three in on a lesser moral count he does not define. The headline did not get the memo.
The text he cannot confirm is the one @CBS already has. Days later she writes one of the defendants that none of the sexual stuff was illegal. Giuffra confirms she texted him and cannot confirm the exchange. Denial, he says. Rumors spread, and she came to the realization she had been gang-raped.
The @nytimes has the mechanism: a Greek-life post a week later was the first time she heard the night called an assault instead of her being a #whore. Realization after a public rename is a sequence. It is not a lab result. Her lawyer waited until she could handle the backlash, then filed 101 pages in 2026. Ready is not the same as contemporaneous.
The cover-up is the upgrade. He thought it was bumbling. Now he thinks @Cornell protected a reputation and a county revenue stream. @hochul called that a failure and the DA’s lack of interviews a failure, and she named @NewYorkStateAG Letitia James special prosecutor. That is a bad investigation. A bad investigation is not yet a plot.
@Cornell still ran a Title IX case for months and, by the president’s count, expelled two, suspended two, missed one who had graduated, and cleared two. Clearing two is a strange way to cover for seven.
So the bullshit is the compression. Incapable from the doorway, ragdoll, fifty men, seven rapists, cover-up, smoking gun.
