These GTC orders were already in place, knowing that brokerages like @etrade were going to force $MMTLP shorts to buy-in after 12/8 meant that a U3 halt before 12/9 was the only way to protect their buddies & the Market overall.
It would be worth looking into who continued to short on 12/8 & to what degree. It might give a clue as to who had inside information.
It looks bad enough that FINRA did nothing to prevent new short positions from being opened on 12/8. Why would FINRA protect investors from buying after 12/8, but NOT protect the investors on 12/8 that likely purchased a borrowed security that can't be located?
When you apply logic to what happened, the only reasonable explanation is that FINRA U3 halted MMTLP to protect their member firms from realizing potential infinite losses.
