Listened to the debate between these two Cdes. They all presented their cases, but in the end, there is always one winner. @matinyarare won this first round. Here is why: his arguments were evidence-based and not generalised. He presented knowledge on the constitution and its clauses, along with some fundamentals.
To Cde Mutisi, he must stop name-calling in his arguments and avoid generalisations. He diluted some of his good points with generalisations and meandered here and there.

As stated by Hon @StanleySakupwa2 - the proposed extension of President Emmerson Mnangagwa’s current tenure is constitutionally sound and does not violate the two-term limit enshrined in the Zimbabwean Constitution✅ This interpretation is supported by the structure of our presidential system, existing constitutional provisions, and recent judicial clarification.
1. The Fluidity of Term Length vs. The Rigidity of Term Limits. The life of Parliament is not defined by fixed term limits, and under the Constitution, the President’s term runs concurrently with the life of Parliament. A referendum is not required to alter the duration of a parliamentary session. Therefore, if Parliament exercises its mandate to extend its own life to seven years, the presidential term cycle adjusts accordingly. The extension of the duration of a term does not constitute the creation of a new term in the legal sense.
2. The Legal Definition of a "Term"
According to constitutional interpretation, a “term” is legally defined as a period of three or more years. Consequently, a two-year extension cannot be deemed a separate presidential term. Granting President Mnangagwa an additional two years within his current tenure merely elongates the existing term; it does not trigger a fresh term that would count toward the two-term limit.
3. The Distinction Between Term Length and Term Limits. Section 91(2) of the Zimbabwe Constitution (2013) states: “A person who has already served two terms as President is disqualified from election as President.” This provision strictly governs the number of terms, not the length of a term. Extending the length of a term (e.g., from five to seven years) is fundamentally different from removing or altering the two-term limit. As such, it does not require a referendum, as the core limit on the number of terms remains untouched and fully enforced.
4. The Non-Retroactivity of Constitutional Amendments
Section 328(7) of the Zimbabwe Constitution (2013) provides that: “An amendment to a term-limit provision does not apply to anyone who held office before the amendment.”
Any changes to term length are prospective. This means that even if the tenure is extended, it applies to the current holder without creating a new term that resets the clock. The President is still bound by the two-term limit; he is merely serving out his current (extended) term.
5. Judicial Precedent: Mupungu v Minister of Justice (2021)
The Constitutional Court has provided crucial clarity on this matter. In Mupungu v Minister of Justice (2021), the Court explicitly clarified that extending the length of a term is not equivalent to altering the number of terms. Thus, a two-year extension does not legally count as a new term. @ProfJNMoyo
NB* Since a two-year extension does not constitute a new "term" under the law, President Mnangagwa would not be serving an additional term. He would simply be completing a lengthened first term of the two-term maximum. Therefore, the extension is a procedural matter of tenure duration, not a substantive breach of constitutional term limits.
