Anti-Defection Law and the Constitutional Duty of the Speaker
The Anti-Defection Law, contained in Article 191(2) of the Constitution of India and the Tenth Schedule, was enacted to prevent political defections and protect the mandate of the electorate.
A legislator becomes liable for disqualification if:
He or she voluntarily gives up membership of the political party on whose ticket they were elected; or
Votes or abstains from voting against the party whip without prior permission.
Under Paragraph 6 of the Tenth Schedule, the Speaker of the Legislative Assembly is the constitutional authority empowered to decide disqualification petitions arising from defection.
Although Article 212 protects legislative proceedings from challenge on procedural grounds, the Supreme Court has held that the Speaker's decisions under the Tenth Schedule are subject to judicial review.
Honourable Supreme Court Decisions
Kihoto Hollohan v. Zachillhu (1992): The Speaker acts as a tribunal, and decisions under the Tenth Schedule can be reviewed by courts.
Nabam Rebia v. Deputy Speaker (2016): The Speaker's powers are not absolute and must be exercised fairly and constitutionally.
Keisham Meghachandra Singh v. Speaker (2020): Disqualification petitions should ordinarily be decided within three months, and undue delay is unconstitutional.
Constitutional Duty of the Speaker
The Speaker must:
Consider defection petitions impartially;
Provide an opportunity of hearing;
Deliver a reasoned decision within a reasonable time.
The Speaker cannot pardon, compromise, waive, or dilute constitutional disqualifications, nor facilitate political bargaining or "horse-trading" among legislators.
The Anti-Defection Law safeguards democratic integrity, political accountability, and the will of the electorate. The Speaker has a constitutional obligation to promptly decide disqualification petitions and uphold the Constitution without political bias or delay.
