பஞ்சாயத்து ராஜ் நிறுவனங்கள் (Panchayat Raj Institutions – PRIs) அடிமட்ட ஜனநாயகத்தின் அடித்தளமாகவும், இந்தியாவில் கிராம சுயாட்சியின் முதன்மை கருவிகளாகவும் விளங்குகின்றன. உள்ளூர் சுயாட்சி, அதிகாரப் பரவலாக்கம், பொதுமக்கள் பங்கேற்பு, சமூக நீதி மற்றும் ஜனநாயகப் பொறுப்புணர்வை வலுப்படுத்தும் நோக்கில் 73வது மற்றும் 74வது அரசியலமைப்புத் திருத்தங்கள் கொண்டு வரப்பட்டன.
பஞ்சாயத்து ராஜ் நிறுவனங்களின் முக்கியத்துவம்
1. உள்ளூர் சுயாட்சி மற்றும் பொதுமக்கள் பங்கேற்பு
பஞ்சாயத்து ராஜ் நிறுவனங்கள், உள்ளூர் வளர்ச்சி, நிர்வாகம் மற்றும் பொதுநலன் தொடர்பான முடிவெடுக்கும் செயல்முறைகளில் கிராமப்புற மக்களை நேரடியாக பங்கேற்கச் செய்கின்றன. அவை “மக்களால், மக்களுக்காக” என்ற ஜனநாயகக் கொள்கையை நடைமுறைப்படுத்துகின்றன.
2. மூன்று அடுக்கு அமைப்பு
பஞ்சாயத்து ராஜ் அமைப்பு பொதுவாக பின்வருமாறு அமைந்துள்ளது:
- கிராமப் பஞ்சாயத்து – கிராம நிலை
- பஞ்சாயத்து ஒன்றியம் / வட்டாரப் பஞ்சாயத்து – இடைநிலை
- மாவட்டப் பஞ்சாயத்து – மாவட்ட நிலை
3. அரசியலமைப்புச் சட்டப் பணிகள் மற்றும் பொறுப்புகள்
பஞ்சாயத்து ராஜ் நிறுவனங்களுக்கு பின்வரும் பொறுப்புகள் வழங்கப்பட்டுள்ளன:
- சாலைகள், குடிநீர் வசதிகள் மற்றும் சுகாதார வசதிகள் உள்ளிட்ட அடிப்படை கட்டமைப்புகளின் மேம்பாடு மற்றும் பராமரிப்பு;
- சுகாதாரம் மற்றும் கல்விச் சேவைகளை வழங்குதல்;
- சமூக நலன் மற்றும் வறுமை ஒழிப்பு திட்டங்களை செயல்படுத்துதல்;
- இயற்கை வளங்களைப் பாதுகாத்து நிர்வகித்தல்;
- உள்ளூர் வளர்ச்சித் திட்டங்களைத் திட்டமிட்டு செயல்படுத்துதல்.

73வது மற்றும் 74வது அரசியலமைப்புத் திருத்தங்கள்:
- உள்ளூர் சுயாட்சி அமைப்புகளுக்கு அரசியலமைப்புச் சட்ட அங்கீகாரம் வழங்கின;
- முறையான மற்றும் காலவரையறுக்கப்பட்ட தேர்தல்களை கட்டாயமாக்கின;
- பெண்கள் மற்றும் ஒதுக்கப்பட்ட சமூகங்களுக்கு இடஒதுக்கீட்டை உறுதி செய்தன;
- நிதி மற்றும் நிர்வாக அதிகாரங்களைப் பகிர்ந்தளிக்கும் அமைப்புகளை உருவாக்கின;
- பொதுமக்கள் பங்கேற்பு, வெளிப்படைத்தன்மை மற்றும் பொறுப்புணர்வை ஊக்குவித்தன.
இந்தச் சீர்திருத்தங்கள் ஜனநாயக அதிகாரப் பரவலாக்கத்தை வலுப்படுத்தவும், உள்ளூர் அமைப்புகளை பயனுள்ள சுயாட்சி நிறுவனங்களாக உருவாக்கவும் நோக்கமுடையவையாகும்.
அரசியலமைப்புச் சட்டக் கவலை
கிராமப் பஞ்சாயத்துகள் மற்றும் பிற பஞ்சாயத்து ராஜ் நிறுவனங்களின் அரசியலமைப்புச் சட்ட அதிகாரங்கள், செயல்பாடுகள், தன்னாட்சி அல்லது நிதி அதிகாரங்களை பலவீனப்படுத்தும், குறைக்கும், மாற்றும் அல்லது வேறு வகையில் பாதிக்கும் நிர்வாக, செயற்குழு அல்லது சட்டமன்ற நடவடிக்கைகள் எடுக்கப்பட்டால், அவை 73வது மற்றும் 74வது அரசியலமைப்புத் திருத்தங்களின் ஆவி, நோக்கம் மற்றும் இலக்குகளுக்கு முரணானதாக இருக்கக்கூடும்.
பஞ்சாயத்து ராஜ் நிறுவனங்களின் தன்னாட்சி குறைக்கப்படுவது, அடிமட்ட ஜனநாயகம், ஜனநாயக அதிகாரப் பரவலாக்கம் மற்றும் உள்ளூர் சுயாட்சியை நோக்கமாகக் கொண்ட அரசியலமைப்பின் பார்வைக்கு தீவிரமான விளைவுகளை ஏற்படுத்தும்.
கோரிக்கை (Prayer)
எனவே, இந்திய அரசியலமைப்பின் அனுச்சேதம் 32-ன் கீழ் மாண்புமிகு ________ மற்றும் இந்திய அரசியலமைப்பின் அனுச்சேதம் 226-ன் கீழ் மாண்புமிகு ________ ஆகியவை, பொதுநலன் கருதியும், 73வது மற்றும் 74வது அரசியலமைப்புத் திருத்தங்களின் அடிப்படை நோக்கங்களை முன்னிறுத்தியும், இவ்விவகாரத்தை பரிசீலிக்குமாறு மிகுந்த மரியாதையுடன் கேட்டுக்கொள்ளப்படுகிறது.
மேலும், மாண்புமிகு நீதிமன்றங்கள் தகுந்ததாகக் கருதினால், இவ்விவகாரத்தில் தாமாக முன்வந்து (Suo Motu) நடவடிக்கை எடுத்து, சம்பந்தப்பட்ட அதிகாரிகள், துறைகள் மற்றும் அரசுகளிடமிருந்து விரிவான அறிக்கைகளை கோரி, பஞ்சாயத்து ராஜ் நிறுவனங்களின் அரசியலமைப்புச் சட்ட தன்னாட்சி, அதிகாரங்கள் மற்றும் செயல்பாடுகளைப் பாதுகாக்கத் தேவையான உத்தரவுகள், வழிகாட்டுதல்கள் அல்லது பிற தகுந்த ஆணைகளை பிறப்பிக்குமாறு பணிவன்புடன் வேண்டப்படுகிறது.
பஞ்சாயத்து ராஜ் நிறுவனங்களைப் பாதுகாப்பது என்பது வெறும் உள்ளூர் அமைப்புகளைப் பாதுகாப்பது மட்டுமல்ல; அது இந்தியாவின் அடிமட்ட ஜனநாயகத்திற்கான அரசியலமைப்புச் சட்ட அடித்தளத்தையே பாதுகாப்பதாகும்.

It is Highly necessary that the Moolavar (Presiding Deity) and Utsavar (Processional Deity) idols of temples, which are presently kept in Idol Protection Centres for safe custody, be restored to their respective temples based on due legal and administrative procedures, considering their historical, spiritual, religious, and cultural significance.
The Moolavar and Utsavar idols consecrated in temples are not merely objects of art. They are the focal point of the faith of devotees and represent divine symbols that have been worshipped for several centuries. While it is necessary to keep idols recovered due to theft, smuggling, or security concerns in protection centres for their safety, retaining them there permanently may adversely affect the traditional worship practices and Agama-based rituals of temples. Further, prolonged storage may also result in changes to the original nature and condition of the idols due to environmental and maintenance-related factors.
Therefore, all documents relating to the idols kept in Idol Protection Centres, including inscriptions, historical records, temple registers, records of the Hindu Religious and Charitable Endowments Department, and relevant court orders, must be thoroughly examined to ascertain the temple to which each idol rightfully belongs. In particular, it is essential that the registers maintained under Section 29 of the Hindu Religious and Charitable Endowments Act, property registers, and idol registers be comprehensively scrutinized.
Subsequently, necessary security arrangements should be undertaken through coordinated efforts involving archaeologists, idol conservation experts, officials of the Hindu Religious and Charitable Endowments Department, police authorities, and the concerned temple administrators.
Further, when the idols are transported back to the temples, adequate measures must be put in place to ensure their safety, including surveillance cameras, security alarm systems, strong rooms, and continuous police protection and monitoring. The process of re-handing over the idols should be conducted in a transparent manner with complete documentation and proper records.
The restoration of idols to their rightful temples by following due procedures will not only respect the religious sentiments of devotees but will also serve as an important step in preserving the ancient spiritual and cultural heritage of our nation. It will further facilitate the uninterrupted continuation of traditional temple worship and help sustain established religious customs and practices.
Therefore, the Government and the concerned authorities should, on a priority basis, take appropriate steps to ensure that all temple idols presently preserved in Idol Protection Centres are restored at the earliest to their respective temples, after detailed examination and legal verification, and with all necessary security measures in place.

Representation Regarding the Protection of Panchayat Raj Institutions (PRI) and Constitutional Safeguards for Village Self-Governance
Panchayat Raj Institutions (PRIs) constitute the foundation of grassroots democracy and serve as the primary instruments of village self-governance in India. The 73rd and 74th Constitutional Amendments were enacted with the objective of strengthening local self-government, decentralization of powers, public participation, social justice, and democratic accountability.
Significance of Panchayat Raj Institutions
1. Local Self-Governance and Public Participation
Panchayat Raj Institutions enable rural communities to directly participate in decision-making processes concerning local development, governance, and public welfare. They embody the democratic principle of governance by the people and for the people.
2. Three-Tier Structure
The Panchayat Raj system generally consists of:
- Village Panchayat – Village Level
- Panchayat Union / Block Panchayat – Intermediate Level
- District Panchayat – District Level
3. Constitutional Functions and Responsibilities
Panchayat Raj Institutions are entrusted with responsibilities relating to:
- Development and maintenance of basic infrastructure, including roads, drinking water facilities, and sanitation;
- Delivery of health and educational services;
- Social welfare and poverty alleviation programmes;
- Protection and management of natural resources;
- Planning and implementation of local development initiatives.
Objectives of the 73rd and 74th Constitutional Amendments
The 73rd and 74th Constitutional Amendments:
- Granted constitutional status to local self-government institutions;
- Mandated regular and periodic elections;
- Ensured reservation for women and marginalized communities;
- Established mechanisms for devolution of financial and administrative powers;
- Promoted public participation, transparency, and accountability in governance.
These reforms were intended to strengthen democratic decentralization and empower local bodies as effective institutions of self-government.
Constitutional Concern
If any administrative, executive, or legislative measures are undertaken that dilute, curtail, transfer, or otherwise undermine the constitutional powers, functions, autonomy, or financial authority of Village Panchayats and other Panchayat Raj Institutions, such measures may be contrary to the spirit, intent, and objectives of the 73rd and 74th Constitutional Amendments.
Any erosion of the autonomy of Panchayat Raj Institutions would have serious implications for grassroots democracy, democratic decentralization, and the constitutional vision of local self-governance.
Prayer
Therefore, it is most respectfully submitted that the Hon’ble under Article 32 of the Constitution of India and the Hon’ble under Article 226 of the Constitution may, in the larger public interest and in furtherance of the constitutional objectives underlying the 73rd and 74th Amendments, consider examining this issue.
It is further prayed that the Hon’ble Courts may, if deemed appropriate, take suo motu cognizance of the matter, call for detailed reports from the concerned authorities, departments, and governments, and issue such directions, orders, or guidelines as may be necessary to ensure the preservation and protection of the constitutional autonomy, powers, and functions of Panchayat Raj Institutions.
Protecting Panchayat Raj Institutions is not merely about safeguarding local bodies; it is about preserving the constitutional foundation of grassroots democracy in India.
