Who watches the watchers?
In August 2024, the SEC fined OTC Markets Group following allegations of money laundering linked to certain transactions on their platform. The investigation revealed that the platform may have been used to move funds illegally without proper oversight, raising serious concerns about regulatory compliance. Despite the gravity of these allegations, it appears that no referral was made to the FBI or other law enforcement agencies to investigate potential criminal conduct.
This raises an important question: Why was there no referral to the FBI or other law enforcement authorities for further investigation into possible criminal wrongdoing? In previous cases, the SEC has referred similar matters to criminal authorities, such as in the SEC v. Lek Securities Corporation case in 2017, where the SECβs investigation into market manipulation led to criminal charges being brought by federal prosecutors.
Given the severity of the money laundering allegations in this case, one would expect a similar referral to be made. Without such action, it leaves open the question of whether sufficient steps were taken to fully investigate and address the criminal aspects of these activities.
