I Demand Accountability. As a wildlife conservationist and advocate who has spent years examining the Wildlife (Protection) Act, 1972, and its subsequent amendments, I write with grave concern over the continuing commercialisation and misuse of India’s elephants — a Schedule I species entitled to the highest degree of statutory protection. The recent inter-state transfer of the five-year-old female elephant Durga from Assam to the Meenakshi Amman Temple in Madurai, after a gruelling 3,000-kilometre road journey, is only the latest illustration of a systemic failure. Young elephants continue to be moved under the expanded “religious or any other purpose” proviso introduced by the 2022 amendment and the Captive Elephant (Transfer or Transport) Rules, 2024. Permissions may have been formally granted, yet the spirit of Section 40 and the non-commercial intent that once underpinned the Act is being stretched beyond recognition. Long-distance transport of juveniles, questions surrounding ownership certificates, and the risk of veiled commercial transactions raise serious doubts about whether welfare standards under the Prevention of Cruelty to Animals Act, 1960, and the Tamil Nadu Captive Elephants Rules are being meaningfully enforced. The same pattern appears across the country. In temples in Tamil Nadu, Rajasthan and elsewhere, elephants are routinely confined, chained, and put on public display. In Jim Corbett Tiger Reserve, elephant safaris have been resumed after a multi-year suspension that began with the Uttarakhand High Court’s 2018 order citing the Wildlife (Protection) Act and the Prevention of Cruelty to Animals Act. Officials now describe the activity as “regulated” and limited to departmental elephants. Yet the fundamental question remains: is the commercial use of a Schedule I animal for tourism consistent with the protective scheme of the Act? When a mother and calf are pressed into safari service, the welfare implications cannot be dismissed as administrative technicalities. Where are the robust monitoring mechanisms contemplated by the statute? Where is the independent veterinary oversight, the transparent scrutiny of ownership certificates, and the strict prohibition on any form of commercial exploitation that the law was meant to guarantee? The exception carved out for captive elephants was never intended to create a parallel economy of transfers, temple processions and tourist rides. It was meant to manage an existing historical reality while prioritising the animal’s well-being. India’s wildlife is not a cultural prop or a revenue stream. Elephants are sentient beings whose natural ranging behaviour, social structure and psychological needs are fundamentally incompatible with prolonged captivity and forced labour. Every transfer that prioritises institutional convenience over scientific assessment, every safari that places commercial interest above conservation ethics, and every temple that treats a living animal as an ornament, chips away at the protective architecture of the Wildlife (Protection) Act. I call upon the Central and State Governments, the Chief Wildlife Wardens, the National Board for Wildlife, and the judiciary to enforce the letter and the spirit of the law without selective interpretation. Transfers must be exceptional, rigorously justified, and subject to continuous welfare audits. Commercial use in protected areas must be re-examined. Ownership certificates must be verified against actual care standards, not paper compliance. Save the elephants. Not as symbols. Not as attractions.
