Senator Durbin’s argument boils down to this: “It’s already illegal, so why add verification?”
As a fraud investigator, I’ve spent more than 30 years exposing fraud. Theft is illegal. Securities fraud is illegal. Tax fraud is illegal. Bribery is illegal. Yet we still use internal controls, audits, identity verification, and oversight because laws alone don’t prevent misconduct.
The purpose of controls isn’t to accuse everyone of being a criminal. It’s to make fraud harder to commit and easier to detect.
The SAVE Act is based on that same principle. Pretending that “it’s already illegal” is an argument against verification ignores the first rule of fraud prevention: if you don’t verify, you invite abuse.
