Nigeria’s secret and irregular transfer of an individual from Kenya—carried out without the knowledge or authorization of Kenyan authorities—may constitute a violation of several principles of international law.
Such an operation did infringe Kenya’s sovereignty, breached existing extradition treaties or mutual legal assistance agreements, and contravene international human rights treaties that protect individuals from arbitrary arrest, unlawful transfer, and denial of due process.
Even if a lousy court in Nigerian has chosen to proceed with the trial and asserted that the method of transfer does not affect its jurisdiction, Nigeria will still PAY the PRICE of international responsibility for its actions.
This may include responsibility for committing an internationally wrongful act, the obligation to provide appropriate reparations to the injured state or individual, and exposure to potential diplomatic consequences arising from its breach of international legal obligations.
