The National Voter Registration Act's 90-day quiet period exists for one reason: to stop states from purging eligible voters close enough to Election Day that they can't challenge the removal in time. Congress put it there deliberately. It is one of the NVRA's central protections.
DOJ is now arguing in Georgia federal court that the quiet period doesn't apply - as long as removals are done "in an individualized fashion" based on federal referrals rather than a broad systemic program.
Here's what that means in practice. DOJ is suing 30 states for unredacted voter rolls. If it gets that data, it flags names it considers potentially ineligible. It then refers those names to Georgia. Georgia removes them one by one. DOJ argues that's "individualized" and therefore legal inside the 90-day window.
A voter removed from the rolls 60 days before the midterm gets a notice. They have to navigate a challenge process on a compressed timeline. Many won't. The vote doesn't happen. The purge happened anyway - it just happened one name at a time.
Judges in California, Oregon, Michigan, Massachusetts, Rhode Island, Arizona, Wisconsin, and Maine have already dismissed DOJ's voter roll lawsuits. DOJ has appealed every loss. In the Ninth Circuit, DOJ acknowledged a ruling that the quiet period applies to exactly this kind of removal and said Oregon "may be further limited" by it.
Same administration. Different circuits. Different arguments. Whatever interpretation gets the data and enables the removals.
The midterms are four months away. This is not preparation for accountability. This is preparation for the results DOJ can use.
