Memorandum To: Members of the United Nations Security Council
Subject: Reasons to Reject Rwanda’s Request for ICTR/IRMCT Archives and Former ICTR Convicts

The United Nations established the ICTR to prosecute those responsible for the 1994 Rwandan genocide, while the IRMCT was created to preserve its legacy, archives, and residual judicial functions. As the IRMCT reduces its activities, Rwanda has requested custody of the ICTR/IRMCT archives and the transfer of former ICTR detainees and released persons. The Security Council should reject these requests.

1⃣First, the ICTR prosecuted leaders of the former Rwandan Government but did not indict senior RPF/RPA officials despite allegations of crimes committed by all parties. Former Chief Prosecutor Carla Del Ponte stated that investigations into alleged crimes by forces under Paul Kagame’s command were discontinued, leading to longstanding criticism that the Tribunal delivered “victor’s justice” rather than equal justice.
2⃣Second, the archives contain evidence, witness statements, judicial records, and historical materials relating to events in which senior Rwandan officials have been subjects of allegations or investigative interest. As assets belonging to the international community, they should remain under independent international custody. Tanzania, where the ICTR operated throughout its existence, remains the most appropriate location, offering neutrality, stability, security, continuity, and protection against politicization.
3⃣Third, relocating former detainees and released persons to Rwanda raises concerns about fairness, security, and possible political misuse. Many remain associated with former adversaries of the current government and could face intimidation, surveillance, pressure, or the perception thereof. The United Nations should not place former belligerents under the authority of those who emerged victorious from the conflict.
4⃣Fourth, international reports have cited restrictions on opposition activity, civic space, freedom of expression, arbitrary detention, and enforced disappearances. Rwanda has also faced scrutiny over alleged involvement in the conflict in eastern Democratic Republic of the Congo. A state facing persistent questions about compliance with international standards should not be entrusted with archives or responsibilities connected to matters involving its own leadership.

For these reasons, the Security Council should reject the transfer of ICTR/IRMCT archives and former detainees to Rwanda. The archives should remain in Tanzania under international stewardship, and former detainees should not be placed under the authority of a government that was itself a party to the conflict. Preserving the independence, credibility, and impartiality of international justice requires continued international management of the ICTR and IRMCT legacy.

Rien n’a changé. Vingt-cinq ans après, le Rwanda continue exactement le même pillage.

En avril 2001, le Panel d’Experts des Nations Unies sur l’exploitation illégale des ressources naturelles en République démocratique du Congo dénonçait déjà, avec des preuves, le système organisé mis en place par l’armée rwandaise pour piller systématiquement l’est du Congo.

Le rapport désignait nommément les réseaux militaires rwandais, le fameux « Congo Desk », et des officiers supérieurs dont James Kabarebe, comme acteurs centraux de ce trafic massif de coltan, cassitérite, or et diamants.

Ce pillage, concluait l’ONU, finançait la guerre et enrichissait une élite militaire rwandaise.

Vingt-cinq ans plus tard, en 2026, Global Witness et d’autres organisations sérieuses dressent le même constat, avec des preuves encore plus précises : les minerais de conflit congolais continuent d’être blanchis au Rwanda, étiquetés comme « rwandais » et exportés vers les marchés internationaux.

Les mêmes structures militaires, les mêmes noms, dont celui de James Kabarebe (pour la petite histoire sa femme est une cousine de Dafroza Gauthier), reviennent de façon lancinante.

Les mêmes méthodes : occupation de territoires, appui à des groupes armés (M23 et autres), contrôle des axes miniers, et exportation frauduleuse.

Rien n’a changé.

Ni la stratégie, ni les acteurs, ni l’impunité.

Depuis un quart de siècle, Kigali pille le Congo avec une constance glaçante, tout en se présentant sur la scène internationale comme un modèle de gouvernance et de développement.

Le régime rwandais n’a jamais cessé de transformer la tragédie congolaise en business rentable.

Les rapports se succèdent, les preuves s’accumulent, les victimes se comptent par millions, et rien ne bouge.

Le Rwanda continue de nier, de menacer ses accusateurs et de bénéficier d’une indulgence incompréhensible de la part d’une communauté internationale complice ou lâche.

Vingt-cinq ans.

Le même crime.

Les mêmes coupables.

La même indécence.

Le rapport de 2001 n’était pas une erreur de jeunesse du régime.

C’était déjà le système.

Et ce système est toujours en place, plus sophistiqué, mieux protégé, mais rigoureusement identique dans sa logique prédatrice.

Le Rwanda de Paul Kagame n’a pas évolué : il a simplement perfectionné son modèle de prédation régionale.

Il est temps de cesser de faire semblant et de détruire l'image de Kagame en rendant public tout ce qui peut le compromettre et saper son narratif biaisé du sauveur qu'il ne fut pas.

Il est grand temps d'exposer au grand jour le pyromane/faux pompier qu'il a toujours été.
