As AI systems shape public governance, their impact on fundamental rights is more critical than ever. I argue the limits of European legal frameworks including the much-debated EU AI-Act and examine real-world cases where AI challenges fundamental rights.
To address these challenges, I propose a rights-based inter-legal approach, delving into the theory of inter-legality, integrating leading ECtHR & CJEU case law on new technologies and introducing a three-step adjudication model for stronger AI governance.
