The Constitutional Court has ruled that failed asylum seekers in South Africa do not automatically have the right to submit repeat asylum applications after their first applications were finally rejected.
The case involved two Burundian nationals whose original asylum claims were denied in 2014. They later reapplied in 2018, arguing they had become โsur placeโ refugees due to worsening political violence in Burundi after they arrived in South Africa.
In a majority judgment, the Constitutional Court found that the Refugees Act does not currently provide a clear legal framework allowing repeat asylum applications after an initial claim has been rejected.
The Court warned that allowing unlimited repeat applications without proper legislation could create a โnever-ending cycleโ preventing deportations and causing administrative chaos.
The Court therefore overturned the Supreme Court of Appeal ruling that had ordered Home Affairs to consider the new applications.
However, two judges dissented, arguing that denying repeat applications where conditions in a personโs home country have materially worsened could violate the international principle of non-refoulement,
which protects people from being returned to countries where they may face persecution or serious harm.
The majority judgment now stands, meaning repeat asylum applications are not automatically recognised under the current Refugees Act framework.
