I remember someone making the same argument about Dobbs—and now we have women bleeding out in parking lots because their rights to safe medical care were taken away by states under control by people who didn’t care about the polls.
This won’t result in life or death consequences. Even so, I wish we weren’t so cavalier about rights being stripped from people.
Section 1 of the Fourteenth Amendment ended legal second-class citizenship, period. Everyone should enjoy the same legal protections as marriage under the Constitution. This isn’t a political issue, it’s a constitutional one.
The Equal Protection Clause stems from the Fourteenth Amendment of the U.S. Constitution. Specifically, it is found in Section 1, which states: “No State shall… deny to any person within its jurisdiction the equal protection of the laws.”
