Hours later, OpenAI landed a deal with the Pentagon on seemingly identical terms.
But the deals are NOT the same.
Anthropic wanted explicit NEW contractual rules. OpenAI agreed to "any lawful use" and pointed to existing law, adding a cloud-only technical limitation.
One company said the law hasn't caught up with AI. The other said existing law is enough.
Whether cloud-only deployment is a genuine safeguard or a convenient loophole is the question that will define AI governance for years.

The US Department of War has threatened to invoke the Defense Production Act to force an American AI company to remove safeguards against mass domestic surveillance and fully autonomous weapons. When the company refused, the Department threatened to designate them a “supply chain risk,” a label previously reserved exclusively for US adversaries.

An American government agency is threatening to use wartime powers to compel a private company to enable the mass surveillance of American citizens, and to deploy fully autonomous AI weapons that the leading AI company in the world is telling them are not yet safe or reliable enough to use.
This is not a partisan issue. It is not an AI industry issue. It is a civil liberties issue and, at its core, a question about whether humanity maintains meaningful control over the most powerful technologies ever created. And it is happening right now.
