Commissioner Khumalo challenged IDAC Head Advocate Andrea Johnson over her claim that Brigadier Mokwele would have been in a position to loot state funds, asking: "How do you leap to that conclusion?"

Khumalo said Johnson was being "grossly unfair" by attributing potential criminal conduct to Mokwele without evidence. Johnson apologised, saying it was not her intention to impugn Mokwele's dignity or credibility, and ultimately accepted that the same reasoning would apply to any person appointed to the position.
