A federal judge has allowed a fraud lawsuit against Harvard to proceed. The basic allegation is that researchers claimed in NIH grant proposals and progress reports that they were doing one thing while actually doing something else.

If there is a legal basis for this type of lawsuit, the implications are enormous.

Every scientist knows there is a difference between grantsmanship and science. Grant proposals and progress reports are packaged to fit the priorities and narratives most likely to receive funding. Once the grant is awarded, academics pursue work that is very different from what was written in the proposals and progress reports.

If courts conclude that this practice constitutes fraud, the financial consequences for universities will be staggering. Research grants can make up more than half of university revenue especially in medical schools, and the damages dwarf anything seen in civil rights or EEOC litigation.

If this legal theory succeeds, it will alter the course of academia.
