Don't rely on hearsay about what's in statute. My understanding is the law is loophole city. As you say, "Non-reporting doesn't enable direct lawsuits against providers" - I bet you can't find even one example of a penalty specified in statute that could plausibly make such a lawsuit successful. Congress gave the laws about this no teeth. Try hard to prove me wrong!
