Subject: Somalia’s Sovereignty Is Not for Sale: Response to U.S. Congressional Overreach

Dear Hon. Tom Tiffany and Hon. Andy Ogles,

I write to you as a Member of the Foreign Affairs Committee of the House of the People of the Federal Republic of Somalia regarding your recent letter to Federal Republic of Somalia’s Ambassador in Washington, D.C. In that letter, you urged Somalia to reverse its sovereign and lawful decision to invalidate Taiwan-issued passports, threatening severe diplomatic and immigration-related reprisals should Federal Republic of Somalia fail to comply. Your letter condemned Somalia’s decision to ban the use of Taiwanese passports for entry, exit, or transit, mischaracterizing it as submission to the Chinese Communist Party. You threatened the revocation of Temporary Protected Status (TPS) for Somali nationals in US, suspension of visa services, freezing of future bilateral aid, and even the closure of Federal Republic of Somalia’s embassy in Washington, D.C.

You further stated - “If the Somali government insists on acting as little more than a branch office of the Chinese Communist Party, there is no reason for the United States to continue to pretend that it is independent, legitimate, or worthy of U.S. recognition.”
Let me be clear: your letter constitutes a direct and unlawful interference in Federal Republic of Somalia’s internal affairs and a violation of its sovereignty and territorial integrity. This interference contravenes both international law and core principles of U.S. foreign policy, including your government’s official recognition of the “One Somalia” policy - akin to your own adherence to the “One China” principle.

Violation of Article 2(1) and Article 2(7) of the UN Charter – Federal Republic of Somalia, as a full member of the United Nations, enjoys sovereign equality with all other member states. The Charter explicitly prohibits intervention in the domestic affairs of member states. Your threats to withdraw recognition, punish Somali nationals in US, and shutter our diplomatic mission breach this fundamental international law.

Breach of the Vienna Convention on Diplomatic Relations (1961), Article 22 and Article 25 – Your threats to close Federal Republic of Somalia’s embassy and expel its diplomats, absent a formal and lawful process grounded in international norms, disregard the inviolability of diplomatic missions and the duty of the host country to protect them.

Contravention of the U.S. Constitution, Article I, Section 8 – While the House of Representatives has power over appropriations, it does not possess executive authority to dictate foreign policy or engage in direct bilateral coercion. The Constitution vests the power to conduct foreign relations in the Executive Branch, not individual members of Congress.

Violation of the United States’ Official “One Somalia” Policy – The U.S. has long maintained that it recognizes the sovereignty and territorial integrity of Federal Republic of Somalia. Attempting to force Somalia to recognize Taiwan-issued passports is inconsistent with your own longstanding foreign policy and undermines your stated commitment to Somalia’s unity.

Abuse of the Foreign Assistance Act (1961) – U.S. law ties foreign aid to mutual respect and lawful agreements, not unilateral coercion or punitive measures imposed for sovereign decisions consistent with international law.

Your letter appears to be influenced by misinformation circulated by a well-funded U.S. lobbying group that advocates on behalf of the secessionist Regime in Hargeisa and US Taiwan lobbyist. This group promotes the misleading narrative that the northern regions of Federal Republic of Somalia represent a democratic haven resisting China’s influence. Yet, as documented:
o In 1988, the military government of Somalia, with U.S. support, committed atrocities against the Isaaq clan - events which, while tragic, are now weaponized by secessionist Regime in Hargeisa to justify unilateral claims over northern Federal Republic of Somalia, SSC Khaatumo and Awdal State don’t subscribe this secessionist Regime in Hargeisa fantasy.

o In 1991, the Somali National Movement (SNM) committed brutal reprisals and ethnic cleansing against other clans, crimes whitewashed in much of the US Lobbyist narrative. In 2023, the same secessionist Regime in Hargeisa committed well-documented human rights violations against the people of SSC-Khaatumo, a matter now under review by international human rights organizations.

While these lobbyists trumpet the holding of a “one person, one vote” election, they conveniently omit the fact that there was no election in SSC Khaatumo State, and over 25 Chinese Communist Party-affiliated companies operate openly in Hargeisa, holding mining licenses for rare earth elements and importing over $1 billion in Chinese goods annually through Berbera Port. This exposes the rank hypocrisy of their narrative.

Furthermore, regarding your threat to revoke Temporary Protected Status (TPS) for Somali nationals in US - a program granted since the administration of President George H. W. Bush and consistently renewed by successive presidents - I must emphasize that while such decisions fall within the purview of U.S. domestic policy, the United States is a nation governed by the rule of law. Every Somali citizen under TPS enjoys legal protections, including the right to due process, as stipulated by U.S. law and reinforced by international legal instruments to which the United States is a signatory, particularly the 1951 Refugee Convention and its 1967 Protocol, and relevant provisions of the Geneva Conventions.

It is critical to underscore that any legislative actions you pursue in the House of Representatives, while politically symbolic, do not carry direct legal effect over executive branch decisions concerning immigration enforcement or the administration of TPS. Therefore, while you may recommend or advocate revocation, the ultimate authority resides with the Executive Branch, and all actions must comply with U.S. constitutional protections, statutory law, and binding international obligations.

Let me be unequivocal: Somalia’s sovereignty, territorial integrity, and dignity far outweigh any conditional foreign aid. If the House of Representatives is inclined to recommend terminating such aid, so be it. We are prepared to withstand such measures rather than capitulate intimidation.

To be candid, I note that last year’s proposed bill barely advanced first stage and has not moved beyond public statements and media posturing. How, then, should anyone take seriously these extreme suggestions, which have not even found substantive footing within your own legislative process? It is clear that these gestures serve more as political sound bites aimed at appeasing wealthy Taiwan lobbyists and U.S.-based agents of the One Tribe secessionist regime. These lobbyists, while purporting to advocate for the impoverished people of northern Federal Republic of Somalia, have in fact funneled millions of U.S. taxpayer dollars into the pockets of Washington firms - enriching themselves by selling a fantasy of recognition that they know full well will never materialize under international law. Such transactional lobbying not only misleads your constituents but also undermines genuine diplomacy, squanders public resources, and perpetuates false hopes at the expense of both Somali unity and U.S. foreign policy integrity.

I strongly advise that you resist the pull of misinformation and the self-enrichment schemes of lobbyists who profit from false promises of “nationhood” for a secessionist movement lacking any legal basis under international law. Do not let these schemes erode the historic and valued relationship between our nations.

I therefore caution that any attempt to circumvent these legal safeguards not only risks judicial invalidation but would also gravely damage the United States’ reputation as a nation that upholds the rule of law and honors its international obligations. Sovereign nations are not subject to the whims of legislative threats, and Federal Republic of Somalia will not tolerate attempts to subordinate its dignity and sovereignty to foreign pressures.

I am currently in Washington, D.C. and would be pleased to meet with you to clarify the facts and discuss the critical importance of upholding the One Somalia policy - a matter of vital national interest.

Federal Republic of Somalia will not permit Taiwan, or any external actor, to undermine its sovereignty. We will act decisively, by all means necessary, to defend our territorial integrity and uphold One Somalia.

I trust that these attached references will provide clarity and factual grounding to the issues at hand. I encourage a thorough review of this material to avoid the pitfalls of misinformation and ensure that any further correspondence between our countries reflects respect for international law and mutual sovereignty.
