Senator Jacob Howard authored the citizenship clause of the 14th Amendment in 1866. He stood on the floor of the United States Senate and said it himself.
The amendment would NOT include, he stated, "persons born in the United States who are foreigners, aliens."
Read that again. The author. His own words. On the record.
The 14th Amendment was written for one purpose. To grant citizenship to freed slaves after the Civil War. That was the whole point. That was the entire debate.
Nobody in that Senate chamber was talking about people sneaking across a border a century later and having a baby.
Yet here we are. A clause written to correct the injustice of slavery has been twisted into a loophole that hands out citizenship like candy to anyone whose mother can make it to American soil in time.
Trump is not attacking the Constitution. He is demanding we read it the way its author actually wrote it.
The man who wrote the law agreed with Trump. That should settle it.
The framers of the 14th Amendment were very clear about Birthright Citizenship:
"This will not, of course, include persons born in the United States who are foreigners, aliens..."

🚨 JUSTICE THOMAS JUST DROPPED A 91-PAGE DISSENT ON THE SUPREME COURT'S BIRTHRIGHT CITIZENSHIP RULING:
The last time a Justice wrote this long in dissent, it became the founding document of the next constitutional revolution.
– Roberts wrote the majority. Barrett and Kavanaugh joined. Birthright citizenship upheld 6-3. Trump's January 20 executive order struck down.
– Thomas wrote 91 pages. The longest dissent of his entire tenure on the Court.
– Nearly half of the 194-page total opinion is Thomas — alone — making the case that the majority got this wrong.
– His core argument: The Citizenship Clause was written for freed slaves who had "no other homeland." It was never meant for children of foreign temporary visitors still "attached to their home country."
– Thomas's exact words: The majority is "repurposing" the 14th Amendment "to protect its own set of preferred rights that the Reconstruction Congress never contemplated and that cannot find support in its text."
– He went further: "Today, the Court does so again by recognizing a constitutional right to citizenship for the children of all foreign birth tourists and illegal aliens."
– And then the closing line: "Today's opinion devalues that citizenship. I respectfully dissent."
– The 1898 precedent the majority relied on — Wong Kim Ark — involved parents who were domiciled, legal, permanent residents. Thomas says that case has nothing to do with temporary or unlawful entrants.
– Gorsuch joined Thomas. Alito dissented separately. Three dissenters total.
– The ruling leaves one door open: visa denials for suspected birth tourists remain intact through CBP authority.
Thomas doesn't write 91 pages to lose gracefully. He writes 91 pages to give the next Court a roadmap.
Whatever today's majority says is settled — Thomas just made sure it isn't.
