This is a dangerous path for our courts to take, and one that must be corrected through vigorous litigation and principled constitutional adjudication.
In H.E. Gachagua's case, the contradiction is striking. Having found that the hearing violated the non-derogable right to a fair hearing and the principles of natural justice, it is illogical and troubling for the Court to subsequently uphold the outcome of that tainted process.
