KRA is not playing with London Distillers.

You definitely know London distillers. They cook and sell alcohol.

In 2020 and 2021, they sold alcohol and charged customers excise tax on behalf of KRA.

Excise tax is a tax govt charges walevi to discourage excessive drinking.

London Distillers then filed its own excise tax returns and told KRA: We owe you Ksh 895 million.

Note, KRA did not assess this tax. It is London Distillers that admitted it owed KRA the money.

That statement is the heart of this tax fight. Read it again.

The company paid Ksh 378 million and left Ksh 517 million outstanding. KRA immediately started pursuing the balance.

Then someone at London distillers came up with another idea.

Instead of negotiating with KRA, let's talk directly to the CS for Treasury Ukur Yatani and ask him to forgive the 517m.

The directors said, perfect! Go for it. Do it! Fast!

They wrote to the CS. Told him they are unable to pay. The CS agreed.

In January 2022, Treasury directed KRA to cancel 80% of the outstanding tax, plus 100% of the penalties and interest. London to pay 20% only.

London Distillers happily returned to Athi River thinking the tax fight was over.

KRA, however, retreated to Times Tower and embarked on a fault finding mission. They wondered,

How will we meet our tax collection targets if the person setting those targets can forgive taxes anyhowly?

Then one afternoon, KRA finally finds the fault. There is one dangerous sentence sitting quitely in Kenyan tax law. It says,

• Only KRA can initiate tax cancellation after determining that recovery is impossible, unduly difficult or expensive, or would cause hardship or inequity to the taxpayer. KRA then forwards the recommendation to the CS for approval. The CS cannot start the process or issue the directive on his own.

KRA sought the Attorney General's opinion of this sentence.

The AG, Kihara, agreed that Treasury's directive was illegal. Because,

- London Distillers had already collected the excise duty from consumers.
- The money was never London's.
- They were merely holding it on behalf of KRA before remitting it.
- They must pay it to KRA.

The AG gave KRA the green light to continue pursuing their tax.

When Treasury saw the AG's opinion, it quickly withdrew the letter. KRA resumed the hunt for its Ksh 517 million undettered.

When London Distillers saw KRA was not playing, they ran to the High Court and later to the Court of Appeal.

London Distillers argued that:
- KRA had no right to ignore or reverse a directive that had come from the National Treasury.
- They accused KRA of usurping powers that properly belonged to the National Treasury & Cabinet Secretary.
- They had legit expectations that the govt could not forgive tax and later unforgive it.

This week, the Court of Appeal has ruled that,

- A Cabinet Secretary cannot wake up one morning and cancel taxes that the law does not allow him to cancel.

London Distillers has been ordered to pay the Ksh 517 million.

Case closed.

Lessons.

• Self declared taxes are admissions. Don't assume they can later disappear through letters to Treasury.

• Excise duty and VAT collected from customers are public money. You are only holding them for KRA.

• If you disagree with a tax, challenge it through the objection and appeal process. Don't build your cash flow around the hope that someone at Treasury will make it disappear.

Save for the hearing of a petition challenging the election of President, the Supreme Court sittings are virtual, with Judges attending from their homes and hotels or bars (at Water Front for instance). Tribunal hearings are equally virtual. Why do we need a Supreme Court building at a cost of Kshs 26B?

Put up a tent at Uhuru Park as and when a petition challenging the election is filed. The consumption of hot air and the chasing of geese is better done in a big open space.

KRA has clarified something many employed Kenyans ignore.

They are shocked.

In simple terms.

If you are employed and you have a side hustle, you must report ALL your income in your usual annual tax return.

Not salary alone.

For example
- You earn a monthly salary, PAYE deducted
- You freelance on weekends
- You run a small online business
- You farm in ushago
- you own houses and earn rental income

KRA wants you to add everything together. And pay taxes on these additional incomes.

Why?

- Because PAYE only taxes your salary.
It does not “close” your tax affairs.

Taxes on the rest of the incomes are left hanging.

What people wrongly assume:

- “PAYE is final”
- “Side hustle money ni kidogo sana”
- “After all, how will KRA notice or catch me?”

But in reality
- Some banks report you to KRA thro CRS
- Platforms like Airbnb, Upwork , et al, report you to KRA
- Tenants report you to KRA
- The salty ex you dumped because she was boring reports you to KRA
- Digital trails exist

Result
- Unreported income attracts penalties & interest
- Audits years later = painful tax bills
- Maximum chest pain.

In simple, KRA's position is:
- One person.
- One PIN.
- One tax return.
- Report everything.
- Pay tax on everything

That's the law.

Today in the morning I want to strongly condemn these acts of police brutality , criminality and abuse of human rights perpetuated by police officers in Nandi hills Town, Nandi county to peace loving youth who their only mistake was play pool game which is NOT an offence in any of our laws.

Under the constitution of Kenya 2010 ARTICLE 244 the National police 'service' is mandated to respect human rights, promote high standards of professionalism, good relationships with broader society and integrity this provision has been VIOLATED by these rogue police officers.

DEMAND that immediately the inspector General of police kanja should immediately interdict and suspend the said police officers for this act of impunity. This is to also pave way for the independent investigations to be carried out.

Their superiors including those in county security team must face full administrative action ASAP.

SECONDLY, the independent policing oversight Authority (IPOA) should immediately start investigations with a view of prosecution ; it has to be noted that IPOA has been reluctant to prosecute the police officers who were involved allegedly in killings in kimwani area, Nandi county.

THIRDLY I have engaged the senate committee of National security to sua moto look into the matter urgently. While we are in contact with said youth to ensure justice is served to them.

FINALLY the National security leadership must move in to prevent such acts of some rogue police acts which is re-emerging frequently.

WE shall PURSUE these rogue police officers ruthlessly until they pay for these heinous acts against my people.

Let me tell you something,

THE GOVERNMENT IS BROKE.

Don't be fooled by stories.

When Uhuru borrowed EUROBOND, the aim was to free the domestic financial market [Banks, SACCOs] because the government didn't have to borrow locally.

This means it would be easier for you to borrow locally [Loans] to do business or invest.

Banks would be hawking loans, their loan agents loitering in offices, begging you to apply for loans.

This occurred during Kibaki's presidency. Bank loans were easily given.

But because Uhuru misused the Eurobond, the government is now borrowing locally to fund the budget.

Go to a bank and apply for a loan, and see if you will be given one.

You won't.

The interest is also high.

Because the Government is heavily borrowing from local banks, and for banks, the Government is a profitable customer.

It is the reason why so many microfinance kiosks are mushrooming everywhere, taking advantage of the desperation of Kenyans seeking credit.

But do you know who will pay for these loans?

Your TAXES.

Do you know whose money is in these banks?

It is YOUR MONEY.

Banks don't have money.

The money in banks is your salary, your business income, your profits, your M-Pesa deposits. All these funds are held by these banks for your benefit.

The government borrows your money from these banks, then repays your money in the banks with your taxes.

The government has to:

• Pay Eurobond

• Pay bank loans

• Pay salaries

• Fund infrastructure development

• Fuel the president's car

These can only be achieved by either DEFAULTING on these loans or raising TAXES.

Therefore, the banks and government are doing business [illegally] with your money.

This illegal business between the government and the bank is not making sense.

Here is why,

The total assets of banks are KES 7.7 trillion.

Banks have loaned people [You and me] KES 4.0 Trillion.

Banks have loaned the government KES 6.8 trillion.

6.8 + 4.0 = 10.8.

10.8 loaned against their assets of 7.7 is impossible. Does that mean banks made a loss of 3.1 trillion?

This is not sustainable.

Meanwhile, for this government to function, it has to create a sovereign fund, an infrastructure fund and other funds like a housing levy [which are illegal] to survive.

Countries create this fund as a basket for surplus revenue or profit from their exports, such as the sale of Oil.

A fund is a separate basket, distinct from the consolidated fund, where money is pooled and kept for future use.

Since these funds are not sanctioned by parliament, they can't be audited or budgeted constitutionally.

President Ruto must do the right thing and stop going around corners.

Arrest the people who pocketed EUROBOND,

He knows them.

DON'T PAY the illegal debts.

He knows he will ultimately default.

Otherwise, the next finance bill will be worse.
