The Court of Appeal has set aside its own 29 May 2026 ruling in the NSSF appeal after acknowledging that it ruled on an application that was no longer live.
— The Court said the ruling dealt with a spent 2022 stay application, instead of the pending 2024 joinder application by the Kenya Export Floriculture, Horticulture and Allied Workers Union.
— The Court noted that the application that had actually been heard remained undetermined, while the one determined had already been overtaken by events.
— The Court said public confidence in the administration of justice was at stake because parties had not been heard on the application that was wrongly ruled on.
— The 29 May 2026 ruling has now been set aside in full, with the pending joinder ruling scheduled for 3 July 2026.
— This does not determine the main NSSF appeal; it corrects a procedural error and returns the matter to the proper track.
