Here's when the Sectional Properties Act, 2020 applies in Kenya.
1. The Act applies to land held under a freehold title.
This means the owner has indefinite ownership of the land.
2. It also applies to leasehold land, but only if the lease has at least 21 years remaining.
If the unexpired lease term is less than 21 years, the Act does not apply.

3. Another key requirement; there must be an intention to confer ownership.
Simply put, the development must be designed so that individual units, such as apartments, offices, or shops, can be owned separately.
