Here’s the upshot:
1️⃣ The Judicial Review was initially against both the Home and Communities and Local Government Departments. This was because of the cables.
2️⃣ It appeared initially as if the Home Office’s decision to “mitigate” the cables risk could be a material planning matter for the purposes of Steve Reed’s decision, and therefore reviewable.
3️⃣ Through disclosure it was revealed that the decision to mitigate the cable risk was taken in November 2025. The Home Office argues that this decision was taken entirely independently, and was not communicated to Steve Reed’s Department.
4️⃣ This doesn’t seem very plausible to us, but it means that our ground for drawing the Home Office into the JR doesn’t apply (pending some grand revelation, which is unlikely). End result: we are withdrawing it.
5️⃣ Grounds 1-3 of our argument have *already* been given a hearing in July.
Today is about whether Ground 4 of our claim should proceed to a full hearing alongside Grounds 1-3 which are already going to a full hearing.
6️⃣ Ground 4 is about whether the SSCLG should have either made China pay for the mitigation measures planned by the SSHD (eg cable relocation) or, if not, then take into account the cost to the public purse of those measures before granting planning permission.
7️⃣ Whatever the outcome today, Grounds 1-3 are already proceeding to the full hearing. You only need to win on one ground.
