पटना हाई कोर्ट ने जून 2024 में बिहार के 65% आरक्षण कानून को रद्द कर दिया था। अदालत का मानना था कि आरक्षण बढ़ाने के लिए केवल जनसंख्या का अनुपात पर्याप्त नहीं है। इसके पीछे पर्याप्त संवैधानिक और तथ्यात्मक आधार भी होना चाहिए।

हाई कोर्ट के फैसले में उद्धृत आँकड़ों के अनुसार, SC, ST, EBC और OBC/BC समुदायों की सरकारी कर्मचारियों में संयुक्त हिस्सेदारी लगभग 68.52% बताई गई थी।
लेकिन सवाल है—क्या संयुक्त आँकड़ा हर वर्ग के पर्याप्त प्रतिनिधित्व को साबित करता है? बिल्कुल नहीं! वर्गवार आँकड़ों का विश्लेषण भी जरूरी है।

बिहार सरकार ने अपनी दलील में कहा कि 50% आरक्षण सीमा कोई ऐसी अटल सीमा नहीं है जिसे असाधारण परिस्थितियों में कभी पार ही नहीं किया जा सकता।
सरकार ने Indra Sawhney मामले के फैसले का हवाला देते हुए असाधारण परिस्थितियों के आधार पर अपनी बात रखी है।

यदि किसी भर्ती में आरक्षण 50% से बढ़कर 65% हो जाता है, तो EWS को अलग जोड़ने से कुल आरक्षण 75% तक पहुँच सकता है।
इसका सीधा असर खुली प्रतियोगिता के लिए उपलब्ध पदों के अनुपात पर पड़ सकता है। हालांकि, अनारक्षित पद सभी पात्र अभ्यर्थियों के लिए खुले होते हैं।

अगर सरकारी नौकरियों में प्रतिनिधित्व की बहस हो रही है, तो सभी समुदायों के वर्गवार और सत्यापित आँकड़े सार्वजनिक क्यों न किए जाएँ?
किस वर्ग की आबादी कितनी है? सरकारी सेवाओं में उसका प्रतिनिधित्व कितना है? और किस आधार पर आरक्षण बढ़ाने की आवश्यकता तय की गई?
इन सवालों का जवाब आँकड़ों से मिलना चाहिए, नारों से नहीं।

एक बात स्पष्ट रहे—सुप्रीम कोर्ट में याचिका दायर करना और अदालत से अंतिम मंजूरी मिलना दो अलग बातें हैं।
जुलाई 2024 में सुप्रीम कोर्ट ने हाई कोर्ट के फैसले पर तत्काल रोक लगाने से इनकार किया था। इसलिए केवल याचिका के अंशों को देखकर यह दावा करना गलत होगा कि 65% आरक्षण को मंजूरी मिल चुकी है।

सरकार का तर्क है कि 85% आबादी वाले समुदायों से सिर्फ 18% से कम कर्मचारी हैं, और 50% आरक्षण की सीमा को तोड़ने के लिए जाति जनगणना के आधार पर किया गया 'सामाजिक टेस्ट' ही असाधारण परिस्थिति है।

अब अंधभक्त कहते हैं कि कांग्रेस आ गई तो सौ प्रतिशत आरक्षण हो जाएगा उन्हें अपनी आंखों से कीचड़ साफ करना चाहिए।
