My take on 16th July's PIL W.P.(C) 9498/2026 and 19th July 2026 court rulings(as provided by news sources)
Freedom of Speech (Article 19):-
A hunger strike is widely recognized as a form of symbolic speech and peaceful protest, protected under Article 19(1)(a) and 19(1)(b) 2. When the State forcibly @CPDelhi@DCPNewDelhi@mygovindia@HMOIndia@MLJ_GoI intervenes, it not only breaches bodily integrity but also effectively terminates the individual's @Wangchuk66 chosen method of political expression @CJP_for_India.
Bodily Autonomy (Article 21):-
As a conscious adult, Wangchuk has the right to refuse intravenous fluids or force-feeding. Forcible administration violates his informed consent. Common Cause v. Union of India

Traditional Criteria for Public Interest Litigation:-
The rule of locus standi (the right to bring an action) is relaxed, allowing any public-spirited individual or organization to file a petition behalf of "marginalized, illiterate, and poor" who, by reason of their poverty or socially/economically disadvantaged position, are unable to approach the court for relief (S.P. Gupta v. Union of India, 1981). @indSupremeCourt
Given that Wangchuk is a competent and conscious individual, the maintainability of a PIL filed by an unrelated third party (Rakesh Kumar Saini) is a valid point of legal contention.
Since Wangchuk is capable of seeking legal remedy @KapilSibal@VTankha himself (or through his family @GitanjaliAngmo@abhijeet_dipke), a third-party PIL could be seen as an unnecessary interference in a private matter.
Abuse of Process:-
Courts often dismiss PILs that are filed for personal or political agendas under the garb of public interest.
Without any clear order for arrest or detention Police forcefully removed Sonam wangchuk from a peaceful protest platform where monitoring health conditions could have been done without any friction.
The assertion that Wangchuk's personal freedom is being violated is legally substantial. The forced medicalization of a conscious, protesting citizen directly conflicts with the Supreme Court's jurisprudence on bodily autonomy and the right to refuse treatment.
