More information emerging about the conviction of Del Somerville (jailed for two years for throwing a plastic bottle and telling police officers to 'F**k off' at a protest against the small boats).

The court heard that Somerville had played a relatively minor role at the incident, had tried to pull another protester away when he confronted police, actually lived at the marina rather than travelled there for the purpose of protesting, and that the plastic bottle he threw was 'small' or 'empty'.

It's impossible, in the context of wider sentencing policy in this country, to avoid the conclusion that the sanction handed down to Somerville amounts to two-tier justice.

I do not condone throwing objects at or abusing the police.

But it is hard to believe these sentences aren’t politically motivated.

I would much rather see rapists, paedophiles and sexual abusers be made an example of over people throwing plastic bottles in the air or writing Facebook posts.

🚨BREAKING: A Portsmouth father of two has been jailed for two years after throwing a plastic bottle towards a police line and swearing at police at illegal migrant protest in Portsmouth.

• Del Somerville, 42, is the first person jailed over the 6 September demonstration. He admitted violent disorder at Portsmouth Crown Court. About 120 migrants had been brought ashore by the RNLI after a Channel pickup.

• Judge Daniel Sawyer (right pic) called him a “thug” and said the sentence was meant to deter others after later protests. Body-worn video showed him throwing a small bottle at a police line on Ferry Road just before 23:30.

• Four other men charged with violent disorder from the same protest are awaiting sentence.

• For comparison, Judge Sawyer spared Bradley Tolfrey jail in May after he threw three knives at police officers, threw glass at the officers, threatened to slit their throats, spat at an officer, racially abused an officer, pretended to have a gun, covered himself in petrol and threatened to set himself on fire.

• Tolfrey, who had 21 previous convictions for 44 offences, and who committed the offences a month after a 26-week suspended sentence expired, was made subject of a 24-month community order.

• Judge Sawyer was recently investigated for harassment of a female barrister using an anonymous social media account after she complained about how rape victims are failed by the UK justice system.
