Following South Africa’s request for at least 18 months to respond to Israel’s Counter Memorial in the baseless case that South Africa itself initiated against Israel, the Court has granted a period of three years for the next round of written pleadings.
As noted in the Court’s Order, South Africa sought to justify its request on the basis of (1) the alleged complexity of the case; (2) the “voluminous nature” of Israel’s Counter Memorial and supporting annexes; and (3) Israel’s jurisdictional and admissibility objections.
#Israel, for its part, submitted that a second round of written pleadings was unnecessary. Israel’s Counter Memorial, together with the extensive evidence supporting it, demonstrates that South Africa’s allegations are wholly unfounded and that this is a case that should never have been brought in the first place.
This case constitutes a manifest misuse of the Genocide Convention and of the Court itself. Regardless of how long it may take, the only tenable outcome remains the dismissal of South Africa’s claims in their entirety.
