Rapport de l’ONU : Des détenus palestiniens utilisés comme boucliers humains par les forces israéliennes
📌Dans un rapport particulièrement préoccupant, le Haut-Commissariat des Nations Unies aux droits de l’homme dresse un constat alarmant de la situation dans les territoires palestiniens occupés depuis le 7 octobre 2023. 
Selon l’instance onusienne, cette période a été marquée par une intensification sans précédent des violations du droit international humanitaire et des droits humains, imputées aux politiques et aux pratiques mises en œuvre par Israël dans la bande de Gaza ainsi qu’en Cisjordanie, y compris à Jérusalem-Est. 
Le rapport souligne que les opérations militaires conduites dans la bande de Gaza ont provoqué un très lourd bilan humain parmi la population civile, touchant notamment un grand nombre de femmes et d’enfants. Elles ont également entraîné la destruction massive d’infrastructures essentielles telles que les habitations, les hôpitaux, les établissements scolaires ainsi que les réseaux d’approvisionnement en eau et en électricité, compromettant gravement les conditions de vie de la population. 
L’ONU relève en outre des allégations selon lesquelles des Palestiniens détenus auraient été contraints de marcher devant les troupes israéliennes afin de les protéger contre d’éventuelles attaques, une pratique assimilable à l’utilisation de boucliers humains. Le rapport mentionne également que certains détenus auraient été maintenus en détention dans la perspective d’échanges futurs de prisonniers, une situation pouvant, dans certaines circonstances, être qualifiée de prise d’otages. 
Le Haut-Commissariat observe que les ordres d’évacuation répétés, la poursuite des opérations militaires et les restrictions imposées aux déplacements des personnes ainsi qu’à l’acheminement de l’aide humanitaire ont provoqué des déplacements massifs de population à l’intérieur de Gaza. Selon le rapport, ces déplacements se sont déroulés dans des conditions incompatibles avec les obligations de protection qui incombent à une puissance occupante en vertu du droit international humanitaire. 
Le document met également en évidence les conséquences cumulées du blocus, des hostilités et de la destruction des infrastructures civiles, qui ont engendré des conditions de vie extrêmement précaires dans de nombreuses zones du territoire. Ces mesures auraient privé une grande partie de la population de l’accès aux services essentiels, aux soins de santé, à l’eau potable, à l’alimentation et à un logement adéquat. 
Sur le plan juridique, le rapport estime que les moyens et méthodes employés au cours des opérations militaires soulèvent de sérieuses interrogations quant au respect des principes fondamentaux du droit international humanitaire, notamment ceux de distinction entre civils et combattants, de proportionnalité et de précaution. Il conclut que certaines des violations constatées pourraient constituer des crimes de guerre ou d’autres crimes internationaux graves nécessitant des enquêtes approfondies et l’engagement de poursuites.

لبنان يقرر تسليم القرضاوي إلى الإمارات خلافًا للقانون

قرّر مجلس الوزراء اللبناني اليوم تسليم الشاعر السياسي المصري - التركي عبد الرحمن يوسف القرضاوي إلى دولة الإمارات في خرق فاضح للقوانين اللبنانية والاتفاقيات العربية والدولية التي يلتزم بها لبنان. تطالب "المفكّرة القانونية" بوقف تنفيذ قرار مجلس الوزراء إلى حين يتسنّى للقرضاوي مراجعة القضاء للطعن بقرار تسليمه.

وكانت "المفكّرة" قد تقدّمت اليوم بالاشتراك مع مجموعة من المنظمات الحقوقية اللبنانية والمصرية بطلب إلى مجلس الوزراء لرفض تسليمه إلى كلّ من الإمارات ومصر نظرًا للطابع السياسي لطلب التسليم ولخطر تعرّض القرضاوي للتعذيب.
