@CalltoActivism Problem is, you can’t plead the 5th when you’re pardoned… he’ll be held in contempt. You can’t incriminate yourself if you can’t be convicted of the crime remember?
Fauci deserves, at the very least, to serve a year in prison for contempt of congress, and to go down to his grave as a felon.
We, the people, want justice.
And Fauci isn’t the only one, but a great start.
🚨 BREAKING: Rand Paul announces the committee will be voting to hold Dr. Fauci in CONTEMPT OF CONGRESS after Fauci invokes the fifth amendment over 80 times
This carries up to a YEAR of prison time.
Paul argues that Fauci does NOT have a fifth amendment right against self-incrimination, as Biden's autopen pardon protects him. Therefore, Fauci can be COMPELLED to answer questions.
PAUL: "My question was limited to the period of your pardon only. I find your objection UNSUPPORTED and DIRECT YOU to answer the question."
FAUCI: *pleads fifth*
PAUL: "Because you refuse to answer citing a privilege unsupported because of your pardon and after being denied to do so this committee has scheduled a vote next week on a resolution certifying your contempt"
@nmlinguaphile He cooked himself by doing an opening statement. He can now be held in contempt.
@MaggieBrown13 @DavidDmack30 @DerSchwarzBaron As you probably know , or maybe not ,SF dont represent the vast majority of people in 🇮🇪, most have utter contempt for their liberal stupid stance on Gender , immigration and economic policies , they are a populist party , we dont need SF to remind us we are Irish and pro UI
@RGW_TF93 @ElectionWiz Several Senators have brought it up since I posted and Paul has announced a vote on contempt early next week
@RandPaul Another show trial.🤬He smirked @ the questions & didn’t answer. I thought you couldn’t take the fifth if you received a pardon. Why wasn’t he handcuffed & walked out in contempt of court?
@RandPaul Refer him for obstruction and contempt
This is a relatively novel situation of a person with a disputed/disputable pardon being called in front of Congress (not a criminal lawyer) and being called to testify. He won't be in 'contempt of court' but in 'contempt of Congress' which requires a Congressional vote, and then gets sent to the DOJ to see if they can prosecute, and then to a Washington DC court which has definite biases.
If you consider that the 'process is the punishment' then to start the logrolling, you have to get the questions on the record. Then at least you can start hauling him into court every day for the rest of his life. He's 85 now.
If things start getting hectic, he'll start suddenly having 'medical problems'.
@SamAntar His lawyers think the contempt charge will be easier than the charges that will come if he admits to what he wrote in his diary.
Fauci needs to be held in contempt!
a full presidential pardon doesn’t eliminate Fifth Amendment rights overall — but it does remove the privilege against self-incrimination for the specific federal offenses it covers.
the Fifth only applies when there’s a real risk of criminal prosecution. a full pardon eliminates that federal risk for the covered acts, so you generally can’t plead the Fifth to dodge questions about them.
Fauci got a full preemptive pardon from Biden for any federal offenses from Jan. 1, 2014 through the pardon date. he had no valid Fifth Amendment basis to refuse. the only real risk left is public exposure of the record, not prosecution for those acts.
@RandPaul OK, in one post, you claim that he didn’t have the right to invoke the 5th Amendment, and now you seem to be suggesting he has that right. Which one is it, Senator? Knowing this answer will prevent you from making a major fuckup in trying to charge him with contempt.
@OCpatriot_ @VigilantFox Well - why isn’t Hawley DOING anything about this contempt?!?!
Why wasn’t Fauci led away in cuffs??
Will the GOP ever do anything?
@dave_wanted He should be charged with contempt.
What does he have to hide?
@MAHA_Action It’s all a show. Taking the 5th should have never stood. Why wasn’t he held in contempt of Congress?
@alx Last resort. DO IT!
Contempt or compulsion: If a judge or committee determines that a person faces zero legal risk because of a blanket pardon, they can order the person to answer. Refusing to obey that order can lead to a contempt citation or obstruction charges. [1, 2]
@RandPaul Oooooh, contempt. You really got him now.🙄
The Legislative Branch is an absolute joke, failure, and disappointment.
@HawleyMO Hold him in contempt and have him arrested
@VigilantFox @DStrungk Well - why isn’t Hawley DOING anything about this contempt?!?!
