I am reflecting on yesterday's seminal Constitutional Court ruling on the Tagelberg case. I cannot help seeing a powerful continuity from the historic Grootboom case (2000) to Tafelberg. I KNOW THE TWO CASES ARE NOT THE SAME and the facts argued were different. However, thinking critically they speak to each other and reflect positive milestones in South Africa's evolving jurisprudence. They say, in different ways, THE CONSTITUTION WORKS!

I think Grootboom asked whether the Constitution requires the state to provide housing. Tafelberg asks where that housing should be, and whether spatial apartheid itself is a constitutional injury that the government must actively undo. Anyway.....I'm too lazy to write 1000 words on this....this is it. 😃
