For context: ERPNext is open source under GPL 3.0 license. It is meant to be free, but is also paid if you are using it commercially.(I have confirmed from the founder of Frappe that they didn’t have any deal with GoK. So there is a risk of being sued )

ERPNextKenya seems to be under Konvergence Network Solutions, who were among those who won the contract.
The reason the entire deal is outrageous is that the new SHA system wasn’t built from scratch but still this expensive. The software itself wouldn’t cost more than 2 million considering that they just took something that was working before then tweaked it a bit.

So, if the software itself is 0.00001% of the total price, what does the other 99.999999% of the money do?
We just need one Kenyan to show us the contract. That’s where all the answers are.
