🚨 THIS CASE NEEDS ANSWERS 🚨
A Colorado homeowner was arrested after shooting a juvenile who allegedly approached his home late at night.
But here’s where this gets VERY interesting…
Colorado has a law commonly known as the “Make My Day” law — a form of Castle Doctrine that can provide criminal immunity when the statutory requirements for defending yourself against an unlawful intruder are met.
So @LafayettePolice why was this homeowner arrested and what exactly did investigators see that led them to believe the shooting was NOT legally justified?
👇 HERE’S WHAT WE KNOW:
On October 1 in Lafayette, Colorado, police responded to reports of a disturbance and gunshots.
Police initially said a resident had been “alarmed by someone allegedly attempting entry into his residence,” retrieved a firearm and shot the person.
The person shot was a juvenile male.
The homeowner, 52-year-old Robert Loesch, stayed at the scene and cooperated with police.
Then, two days later, everything changed.
After reviewing witness accounts AND video recordings, investigators obtained a search and arrest warrant.
Loesch was arrested and charged with:
• Attempted 2nd-degree murder
• Criminal attempt
• 1st-degree assault
He was released on $25,000 bail.
But now the arrest affidavit has raised even MORE questions.
According to the affidavit, doorbell-camera footage shows the juvenile approaching the residence, attempting to open the storm door, yelling and behaving erratically.
The footage reportedly shows the juvenile picking up a lawn chair and holding it around head level.
Loesch can allegedly be heard saying:
“Don’t you [expletive] do it!”
The affidavit says the juvenile then threw the chair toward Loesch.
Loesch fired.
Then fired a second time.
The juvenile was struck in the abdomen and suffered serious injuries but was expected to survive.
The affidavit also says the chair was recovered and contained a bullet.
And here’s the part that really deserves discussion:
Investigators say they reviewed the video and witness statements before determining there was probable cause to arrest Loesch.
So…
WHAT DID THE VIDEO SHOW THAT CHANGED THIS FROM A POSSIBLE SELF-DEFENSE CASE INTO AN ATTEMPTED-MURDER CASE?
@BldrCOSheriff and @MDoughertyCO Was the homeowner legally justified under Colorado’s Castle Doctrine / “Make My Day” law?
Or did he step outside the protection of that law?
Did the fact that he opened the door and confronted the juvenile change the legal analysis?
Did the video show something investigators believe contradicts his account?
Or is this an example of prosecutors taking an extremely aggressive approach because a juvenile was shot?
And here’s another question:
If the exact same video showed an adult armed intruder instead of a juvenile, would this arrest have happened?
I’m not claiming to know the answer.
I’m asking.
Because that’s exactly what we SHOULD be discussing.
⚠️ IMPORTANT: The charges are allegations. Loesch is presumed innocent unless proven guilty.
This is also a DEVELOPING CASE.
We’ll follow the evidence and bring you updates as they become available.
👇 WHAT DO YOU THINK?
Was this legitimate self-defense—or did the homeowner cross the line?
And @NRA, @GunOwners, and @GunFoundation, I’d love to hear from people who understand Colorado’s self-defense laws.

If your counting holding cells at local police departments then sure, the graphic is right but this is completely wrong. However, on a different note, I’d argue that the price of freedom requires consequences for actions and so there should be even more jails and mental asylums then there is now for accountability, but the “industry” should be privatized for the most part.
@OmnitrixWrist@Legoatjimmy23@iso_hoopps This might be the best argument ever. So one person from each position.
Top SG: MJ
Top PG: Stef Curry or Magic?
Top Center: Kareem/Russell/Wilt?
Top SF: LeBron
Top PF: Duncan/Garnett/Malone?
@vocalizedka@nerd_stink@iso_hoopps 11 title, 7 of them in a row, last two titles he was a player/coach, 5 MVP’s, career rebounds average 22.5, also won Olympic gold and two NCAA titles.
Again, have fun with the opinions.
5 rings, 15 all nba team, 12 all defensive, 4th all time scoring, etc. it might be a bad take but I’m sticking with it. he was a killer and much better leader than LeBron, Never ran off to create super teams just to have a shot. He took the bad with the good. What other names belong? Wilt? George Mikan? Stef Curry? Maybe? Its opinions, have some fun.
He said the same reason we voted for trump, ant-establishment, is the same reason I’m willing to vote for him. My response was “that is weak minded and the left still doesn’t actually have a platform and prescriptions for getting good things done. This war with Iran may have sidetracked the agenda in areas but once it’s done, we can return to normalcy and the “trump economy” and all else that comes with that. But, if you/the voters vote this guy in, and flip congress, the administration and anything it might accomplish once this war is over is dead. Don’t allow the left to get this administration stuck in the mud.”
Something to that affect.
Many of his friends are affluent liberal lefties and haven’t faced a real world problem in years, my B-I-L is included in that and so he is easily influenced. Sad stuff.
After we kill the power grid to kill the internet and electricity so the robot/drone genocide stops, it’ll just be post-apocalyptic rebuild. That’s all. That may be 10, 20, or 100 years. It’ll feel like the post American civil war era but slower and tougher. That’s what I see. Go look at what the elite are hoarding right now, gold, guns, land, and seeds.
@RepBenWaxman No, they should, and they should also have an in person live viewing also. Expose people to the real consequences so we’re not living in the abstract. It’s time for accountability across all levels.
