.@MarkCalabria Claims in GSE lawsuits being brought fwd in most of the Major Court cases are Derivative claims(behalf of COs), why hasnt @FHFA & COs filed suit along side shrhldrs against the Treasury? if FHFAs duty is to restore the GSEs, isnt part of their duty to file a claim?
Re: Fannie/Freddie-Dissecting Penn’s White Paper. Susan Wachter, a co-author, has been talked about as a potential replacement for MC. Was therefore glad to see that the paper 1) supports a privatized utility model over the status quo, 2) suggests that 4% cap reqs are too high.
New Tim Howard
Tim discusses why he believes Secretary Mnuchin failed to deliver on his promise to get the GSEs out of gov control “reasonably fast”& explains why he thinks the chances of accomplishing this goal during the Biden admin should be much better

Sen. Toomey asks Yellen if she's had a chance to look at the PSPA amendment. "I need to look carefully at what's been put in place" she says, adding that "ultimately we need to find a solution that has bipartisan support." Says she will give priority to studying the issue.
@T_Castelluccio @RobMSimone It might not look like it, but JPS stance has improved here. This document has acknowledged that JPS is the key to unlocking this escrow account.
Treasury Department announced changes Thursday that allow Fannie and Freddie to retain their profits to build up hundreds of billions of dollars in capital, in effect indefinitely suspending dividend payments they make to the @USTreasury $fnma $fmcc

The Trump administration has set a path for releasing Fannie Mae and Freddie Mac from government control, but Biden will get to decide whether to take it https://t.co/ZxxOAnUSZb
Furthermore, the litigation settlement explicitly carves out litigation amounts of "less than $5 bn" which we know is the approximate amount of direct claims that will NOT settle regardless of SCOTUS.
We all know 3% Tier 1 cap req is meaningless without SPS forgiveness, BUT we also know that Yellen WAS indeed consulted on this, which corroborates the rumor I heard that Yellen "gave the nod" for 1:1 SPS forgiveness per dollar raised.
Re: Fannie/Freddie-Cake More Fully Baked Than You Think. Still digesting, but here goes: 1) Liquidation pref keeps growing which sounds bad, BUT here's the tell: 2) they're setting a 3% Tier 1 capital requirement AND 3) litigation settlement as an exit precondition...con'td
Mnuchin gave @JanetYellen quite the setup.
In her shoes, I'd be pushing hard to settle - I wouldn't want to oversee a $125 billion loss to a bunch of hedge funds.
OTOH, Mnuchin created a dark enough path for the litigants that it also pressures them to settle.
We shall see...
