🛑REVERSED: A San Francisco federal judge ruled in 2024 that water fluoridation poses an unreasonable risk to children, capping four years of litigation and a record that included the largest scientific review of fluoride data ever conducted. The National Toxicology Program's August 2024 analysis found that 18 of 19 low-risk-of-bias studies reported inverse associations between fluoride exposure and IQ scores in children, and 17 of those were statistically significant.

The Ninth Circuit just overturned that ruling on a technicality. Because the case was filed in 2020, the court determined that Judge Chen should have ruled only on evidence available at that time, meaning the NTP review, the JAMA findings, and everything else the scientific record produced during four years of active litigation must be set aside. The court is not disputing the science. It is saying the science arrived too late to count.

The practical result is that water fluoridation continues while the case is reset, the evidence accumulated over four years is treated as irrelevant, and any new legal challenge will take another five to ten years to work through the same system. The children drinking fluoridated water in the meantime are not afforded the same technicality.

The next step is an appeal to the Supreme Court, where the question will be whether the highest court in the country is willing to engage with what the science now clearly shows is happening to the IQs of American children.
