So happy that my latest article, coauthored with @jananiu, is forthcoming in the @HarvardCRCL Law Review! Using qualitative data and the 5th Amendment's Takings Clause, we argue that harsh treatment of the incarcerated may violate the constitutional rights of free people.
The failure of the state to provide basic necessities to incarcerated populations imposes genuine coercion on private citizens to provide those necessities at personal expense. We analyze this dynamic as a taking. Draft here: https://t.co/KCqBcVYo8K. Comments welcome!
Grateful to have had the chance to present recommendations on human rights and racial justice with @AlexSinha at the White House and deliver a memo to @neeratanden & the Domestic Policy Council.
@JacobDCharles It sounds like I might be an outlier here, but it seems right to me to say the paper benefited from exchanges with any specific people who gave thoughts. But I usually also include a generic acknowledgement of audiences at each workshop, which helps catch anybody I missed by name
Excited to share my latest article, Policing's Free-Speech Problem, forthcoming in the @UtahLawReview. I argue that significant, typical elements of modern policing amount to egregiously unconstitutional viewpoint discrimination. Comments welcome: https://t.co/8wwa675oSd!
