Conduct of Banking Business on Sunday, 27.09.2026 - Negotiable Instruments Act Position

Q1. Is 27.09.2026 a public holiday under the NI Act?
Yes. Section 25's Explanation includes Sundays automatically, without need for any notification.
Q2. Can RBI or the Government notify tomorrow as a "working day" under the NI Act?
No. Section 25 only allows the Government to add extra holidays. It gives no power to remove Sunday's holiday status.
Q3. Does RBI's letter of 22.09.2026 permitting branches to open change this?
No. That is an administrative approval to keep branches operational. It does not, and cannot, alter the day's status under Section 25.
Q4. Does the RBI / NPCI communication of 25.09.2026 on cheque-clearing infrastructure change this?
No. That directs the clearing system to stay available, an operational instruction, not a Section 25 notification. The legal position under Q1–Q2 is unaffected.
Q5. Does the Banking Regulation Act say anything different?
No. It only borrows the NI Act's holiday definition for its own return-filing purposes. It doesn't independently govern branch or cheque operations.
Q6. Can a cheque be paid (encashed) at the counter tomorrow?
No. Presentment must be within "banking hours" (Section 65); a statutory holiday has none for this purpose.
Q7. Can a cheque be accepted for outward clearing tomorrow?*
No, at branch level. Same basis as in Q6
Q8. Can a same-bank/local cheque be credited without external clearing?
No. It is still "presentment for payment" under Sections 64–65, regardless of whether external clearing is involved.
Q9. Is inward/outward clearing settlement itself something a branch officer decides?
No. That runs on HO/RBI-NPCI system settings, not on individual branch action.
Q10. Can a cheque be returned/dishonoured tomorrow?
No. This is the highest-risk item - dishonour timelines feed into Section 138 proceedings. Do not action this on a day of contested status.
Q11. Can a Bill of Exchange be retired (paid) tomorrow?
No. Section 25 applies directly and explicitly to bills of exchange.
Q12. Can a Bill of Exchange be negotiated tomorrow?
No, as a precaution. Section 25 strictly covers maturity, not negotiation, but the same business-day concern applies to the bank's handling of it.
Q13. Can a Promissory Note transaction be processed tomorrow?
No. Section 25 applies directly, as with bills of exchange.
Q14. Can cash deposit/withdrawal be done tomorrow?
Yes. Not a negotiable instrument transaction.
Q15. Can account-to-account transfer, NEFT, RTGS, IMPS or UPI be done tomorrow?
Yes. These are electronic transfers under the Payment and Settlement Systems Act, 2007, not NI Act instruments.
Q16. Can an FD be opened or renewed tomorrow?
Yes. Not an NI Act transaction.
Q17. Can loan recovery through non-cheque mode be done tomorrow?
Yes. Not an NI Act transaction.
Q18. Can a fresh DD/Pay Order be issued against cash tomorrow?
Yes. Issuing an instrument is not presentment for payment.
Q19. Can a DD/Pay Order presented at the counter be paid tomorrow?
No. A DD is a bill of exchange under Section 85A - same basis as Q6.
Q20. What if a customer presents a cheque or DD for payment/deposit?
Inform them politely that cheque-related transactions cannot be processed today as it remains a public holiday under the NI Act, and ask them to return on the next working day.
Q21. What if HO issues a written circular directing cheque clearing/payment tomorrow?
Follow the written instruction. Do not act beyond what it specifically covers, and do not extend it to cheque returns/dishonour (Q10) unless expressly stated.
Q22. What if there is no written instruction, only a verbal one?
Decline politely, record the request and your response in the branch occurrence book, and report it to your Association representative the same day.

बैंक कर्मचारी हड़ताल पर हैं। कारण पूछने पर यही लगा कि जिस बैंक की नौकरी को अच्छी नौकरी में गिना जाता था, उसकी हालत बदतर हो गई है। टारगेट के नाम पर कर्मचारी देर शाम तक रोके जाते हैं, छुट्टी नहीं दी जाती है,
तनाव रोज़ का हिस्सा है। काम करने की जगह भी अच्छी नहीं है। ऐसा लगता है कि बैंकर को सज़ा दी जा रही है कि उन्होंने बैंक की नौकरी क्यों की। लोगों ने बताया कि अत्यधिक तनाव के कारण बीमारियाँ होने लगी हैं।
एक बैंकर ने यह भी बताया-
सुबह 8:00 बजे घर से निकलने वाला बैंकर रात को 8:00 या 9:00 बजे के बाद ही घर लौट पाता है, क्योंकि एनपीए (NPA - गैर-निष्पादित परिसंपत्ति) को रोकने का भारी दबाव होता है। हर खाते की मंथली ईएमआई (EMI) होती है, और यदि वह 90 दिनों तक जमा न हो, तो खाता एनपीए हो जाता है। ऐसे में रीजनल ऑफिस से ब्रांच हेड पर दबाव आता है कि यह खाता आज किसी भी हाल में एनपीए नहीं होना चाहिए। पहले केवल महीने की आखिरी तारीख को एनपीए रोकने का दबाव होता था, लेकिन अब हर सिंगल डे (प्रतिदिन) यह प्रेशर रहता है।
रात के 9:00 बज रहे होते हैं और रीजनल ऑफिस से फोन आता है कि "किसी भी तरह इस खाते को बचाइए।" थक-हारकर जब ब्रांच हेड को लगता है कि उसे अब घर जाना चाहिए, तो वह अपनी जेब से 2,000, 4,000 या 10,000 रुपये तक की ईएमआई खुद भर देता है। बाद में ग्राहक वह पैसा लौटाता नहीं है, जिससे बैंक मैनेजर के अपने पैसे डूब जाते हैं।
बैंक में दिनभर कई तरह के मानसिक तनाव झेलने पड़ते हैं। आपको रिकवरी के लिए फील्ड में निकलना होता है। वहाँ कोई ग्राहक आपको ब्लैकमेल करता है कि "मेरे घर मत आओ, नहीं तो मैं पैसा जमा नहीं करूँगा, सिर्फ़ फोन पर बात करो।" फोन पर बात करने के दौरान ग्राहक कभी-कभी अभद्र और गाली-गलौज वाली भाषा का प्रयोग करते हैं। उस तनाव में यदि मैनेजर के मुँह से गलती से भी कोई गलत बात निकल गई, तो ग्राहक उसकी कॉल रिकॉर्डिंग करके ब्लैकमेल करने लगता है।
