Thelmecia McCoy was given a 1 year/1 day prison sentence for petit theft (3rd conviction). Within 3 years of release she was charged with robbery (no gun/DW) and was sentenced to 16 years under Florida’s #PRR.
Joel was deemed to be “armed” when he stole 2 guns in the burglary, hence his PBL sentence. Many prosecutors have deviated from the PRR designation due to the victim’s wishes, so why was it not done in Joel’s case?!
Joel Daigle was 4 months shy of not qualifying for FL’s #PRR designation. His victim testified in court that he DID NOT want Joel to receive LIFE for burglary & suggested 10 yrs. The prosecutor did not listen, and b/c he was deemed to be PRR the judge HAD to give him life.
In 2021, LE agencies were to convert to the IBRS for reporting crime data. In 2021, only 24 of the approximately 400 Florida agencies reported, 27 in 2022. @GovRonDeSantis "50 year low" comment recently is comical since Florida's crime data will be extremely skewed for years.
Damian Tukes & Dorian Mackeroy, both w/only 1 prior prison sent., both as children (14 & 16) for 4 yrs each, both sentenced to LIFE, both for no physical harm robberies, both now incarcerated over 20 yrs. What is the public safety benefit of keeping them in prison any longer?
What is the public safety benefit of keeping him incarcerated another 20-30 years? The answer is none, yet Florida taxpayers will foot the unnecessary bill because the legislature refuses to amend the PRR sentencing structure retroactively.
Maurice Gilbert, life sentence under FL's #PRR law for armed robbery (no one physically harmed); prior qualifying sentence was 1 yr/1 mo. for cocaine possession, delivery of cannabis, resist LEO w/out violence. Has been in prison for 22 years, is now age 47.
