I’ll be interested to see if no admit/no deny becomes part of negotiated settlements anyway (even if the formal policy no longer exists) or if this is performative. Time was, it was important to some on both sides of the aisle to get admissions in settled cases when possible. No admit/no deny was next best. Will the CFTC just be putting out settlement orders with little or no stated factual basis? Or just the agency’s say-so?
