Renowned artist and United States of America permanent resident Gao Zhen was detained in August 2024 and later charged with the offence of “slandering China’s heroes and martyrs”, apparently in connection with artistic works created years earlier. @GaoBrothers

A 70-year-old artist is facing another day apart from his family & without necessary medical care after almost two years in a Chinese prison, his friends & advocates said.
Gao Zhen, a Christian & part of the famous artistic duo called the Gao brothers, was detained in mid-2024 for “slandering heroes & martyrs,” according to the International Federation for Human Rights. His friends & advocates say he was really detained for his sculptures that critique the country’s authoritarianism, censorship & the Chinese government’s darker chapters of history.

從周世鋒狀告騰訊不得立案說起

7月9日是孫力軍、傅政華政治團夥一手製造的“709律師案”11周年，看了自由亞洲電臺對該案核心人物——刑法學博士、北京鋒銳律師事務所原主任周世鋒的報導，頗有感觸。
我感到我要向周世鋒學習。

周世鋒“近一年先後遭遇微信號永久封禁，出行受限、會友受阻”。這也是我十餘年一直遭遇的境況。2024年8月26日，當局竟然切斷了我家的寬頻、座機和我的手機，這可能比河南安陽市對待周先生更惡劣。我要向周世鋒學習什麼呢？

三次起訴騰訊法院不予立案，六次向中央控告毫無結果

就從微信號被封禁說起吧。

今年7月2日周世鋒正在使用的第5 個微信號又被永久封禁。
之前因為微信號屢屢被封禁，周世鋒分別向深圳市南山區法院和北京互聯網法院起訴騰訊，這兩個法院不接受對騰訊的現場立案和郵寄立案，只受理網上立案，要求提供騰訊法定代表人的手機號、法定代表人和主要負責人的固定電話、身份證及身份證號碼，這實際是剝奪普通公民對騰訊的起訴權。周世鋒前後向上述兩個法院起訴騰訊三次，三次都立不了案。

周世鋒只能走上控告之路。

首先他向中央巡視組派駐北京的巡視組控告北京互聯網法院，法院收了材料，半年不出任何法律文書。他再向中央巡視組反映，北京互聯網法院竟回復“終結審核”。 案都沒立 ，如何終結？這根本不是法律程式，而是繼續剝奪他的訴權。再反映，法院則說“已處理完畢”，根本不講道理。

隨後他向河南省委書記、省紀委書記、省政法委書記兼公安廳長控告安陽市公安局網監“涉嫌充當孫力軍、傅政華走狗，封殺我的微信公眾號”。省紀委批給安陽市紀委，市紀委在批給公安廳紀檢組，紀檢組向他瞭解完情況後，也不了了之了。

今年四月中旬，二十屆中央第七輪巡視完成進駐工作，由15個中央巡視組對36家中央和國家機關開展為期兩個半月左右的常規巡視。本輪巡視重點涵蓋政法、社會工作及民生等領域，被巡視單位包含中央政法委、最高人民法院、最高檢察院、公安部及民政部等單位。”周世鋒前三個微信號被封，還是因為他在朋友圈揭露孫力軍、傅政華政治團夥製造政治迫害案件，揭露該團夥在政法系統裡的勢力還很強，提供了很多證據。” 從第四個微信號起，他不再發朋友圈，不點贊，不再把微信作為言論表達的場所，只是作為與社會保持基本聯絡的通訊工具，但是仍舊被封殺，而且沒有任何司法救濟途徑。就此，今年4月周世鋒及時向有關巡視組分別控告最高法院、公安部網監，控告他們對下屬法院、下屬系統網監“監管嚴重不力，導致孫力軍、傅政華政治團夥流毒持續存在，十分猖獗，他們公然包庇違法企業，拒絕依法立案，報復打擊揭露孫力軍、傅政華罪行的公民，踐踏憲法法律，侵犯公民合法權益。”

他還向有關巡視組以同樣理由控告了北京市高院和廣東省高院。

二十屆中央第七輪為期兩個半月左右的常規巡視，大概在6月底完成，7月2日周世鋒的第5個微信號又被封，證明他持續近一年，先後6次向中央巡視組的控告，沒有獲得任何結果。

我與周世鋒的殊途同歸

我的微信被騰訊無理懲罰要比周世鋒早得多。因為手機可以插兩個電話卡，我就註冊了兩個微信號。其中一個很早就被永久封號，我就連那個電話卡也取消了。另一個2019年就被禁止發朋友圈、禁止入群，只能一對一發資訊，我就這樣忍耐著。2023年8月騰訊突然通知我“違規”，微信要被禁止使用到2023年12月31日。等到年終那天，微信確實開通了，只有7、8個小時，我一言未發，2024年1月1日0時，接到騰訊通知，因“違規”微信要禁止使用到2024年12月31日。等到又一個歲尾，微信確實又開通了，也只有幾個小時，我仍舊一言未發，2025年1月1日0時，我最後一次收到騰訊的通知，因“違規”我的微信號被永久封號。整整一年半，我就眼看著騰訊一個接一個耍流氓的行徑，既沒上訴，也沒想去法院。

我和周世鋒屬於殊途同歸。只是我比他省勁多了。我只把微信稱為流氓軟體，多少年了，朋友聚會，只要有人在微信上露出一點風聲，聚會一定就會被國保攪黃。我和我的眾多朋友採取了同樣態度，流氓軟體，不用也罷。我把騰訊更看成一個流氓大公司，這年頭只有流氓吃的開，和流氓較勁，只能瞎耽誤工夫，白費勁。

周世鋒走的起訴、控告之路是“白費勁”嗎？當然不是，這不僅出於他專業的法律意識，更出於他對騰訊這樣中國的大網路公司性質的認識。依照中國法律，就是起訴國務院、北京市，也不需要總理和市長的手機、身份證，為什麼起訴騰訊就需要普通人無法企及的條件呢？周世鋒認為，騰訊在中國是一個執行特殊任務的政治實體，它的功能遠超其經營範圍，它實際是中共監督言論，剝奪公民言論自由、通訊自由的專政工具的一部分。

這樣的認識，當然值得我學習。
