*The Fall of Ethics and the Rise of Silence in Uniform*
Commendations today are increasingly being misused to shield mediocrity and suppress integrity. They are slowly ruining the very ethics and ethos that once defined our proud military institutions. In any civilised and constitutional setup, silence in the face of injustice is complicity. One must stand against every wrong especially those committed under the garb of authority.
*Legal advice, especially from uniformed legal officers, must flow from the spirit of the Constitution, not from fear or favour.* Officers dealing with grave violations must have the courage to confront wrongdoings, not bury them under the weight of hierarchy or political convenience.
*Shockingly, the very JAG officer who closed the file on the grave incident that occurred on 12 September 2024 at the Military Hospital* an incident witnessed by many, where a woman officer was outraged and her family, including her young innocent son, was subjected to humiliation and mental torture was herself part of the same department. A woman of impeccable service record, married to a veteran of the same legal branch, was silenced in the most disgraceful manner. The cruelty inflicted was not just institutional it was inhuman.
This was not a one-off. It was the fear of exposure, of one truth leading to another, that led to such systemic suppression. What makes it more disheartening is that the same officer was also involved in spreading false rumours, clearly demonstrating how a culture of yes-men is now thriving in the system, replacing honesty with obedience.
*The silence of seniors in the JAG Branch is telling. They must answer What do Regulations Paragraphs 316 and 317 truly mean to them now? What is the value of our legal oath and the "Silver" we once wore on our shoulders with pride*?
Let this Black Day in the history of the JAG Branch be a lesson for the next generation of legal officers. *They will face a choice a stark one between conscience and career.*
May God bless the department with the ethics, ethos, and spine that were once expected of us. And may the legacy we once held dear be reclaimed by those who still believe in justice, honour, and truth.

Who permits forceful action on a women officer in family ward to obtain her statment and used criminal force against her ? Who advised? What is an answer to the eye witness who was forcibly taken out from Court when he was about to convey truth? Why? Who will answer on the actions on abuses by Colonel RM Tripathi to Veteran in court. Evidence of videos lying with them ! Why such action ? Shame!! SHAME!
*MILITARY JUDICIAL SYSTEM: PRESENT STATUS :*
1. *Breach of Oath and Ethical Misconduct* :
Military legal officers are sworn to uphold justice, law, and integrity. When they serve power over truth, they betray that oath. This becomes especially dangerous in a closed system like the military where command influence is enormous and checks are limited.
2. *Distortion of “Principles of Natural Justice* ”:
The bedrock of any fair judicial system : audi alteram partem (hear the other side), nemo judex in causa sua (no one should be a judge in his own cause) is often violated under the guise of "discipline" or "internal inquiry." Many JAG officers either lack proper understanding of these principles or deliberately distort them to serve the whims of senior commanders.
3. *Weaponisation of Legal Advice:*
Instead of acting as impartial legal advisors, some JAG officers tailor opinions to fit the convenience or vendetta of commanders : which leads to misuse of power, illegal confinement, psychiatric abuse, false disciplinary actions, and more. This not only causes individual injustice but undermines the entire credibility of the military justice system.
4. *Lack of Oversight and Accountability:*
Since there’s no independent oversight body, and courts often defer to “internal discipline,” such conduct goes unchecked. This immunity from scrutiny breeds a culture where abuse becomes systemic.
5. *No response or systematic silence when get caught:*
The sad part in the present legal system is to be silent and no response to aggrieved person which in result increase litigation. Since it's matter of public money with no accountability and suits the govt counsels further in their earning things goes on unchecked.
MILITARY JUDICIAL SYSTEM CATERS FOR THEIR ACCOUNTABILITY UNDER SECTION 57 OF ARMY ACT BUT ACCOUNTABILITY IS LACKING IN THE SYSTEM.
SOLUTION :
Solution remains with the judicial courts handling such issues by being deterrent on those who were found being involved in derliction of duties in causing injuries and injustice to aggrieved. The court must heavily come on the govt for huge compensations on such issues to avoid further repetition on any such acts which disgraces the customs and ethos of Armed Forces!
Courts must be careful in examining such issues as these defaulters try to use emotional terms of "national security & "Discipline in Armed Forces" to divert the issue and claimed the false sentiments. Soldier unlike other citizen has to go through many impediments before he approach the court of justice!!
