MA SJC state revision was needed to “vanquish the FICTION OF CONSTRUCTIVE MALICE” to “yield verdicts that are just & fair.” @MACourts recognized these cases would’ve been tried differently now that proof of murderous intent is required, but will not make the changes retroactive.
