According to a report in today’s Irish Times, a Dublin District Court judge has delivered a sharp rebuke of Tusla’s handling of an age assessment case involving a young Somali national charged with the murder of Ukrainian teenager Vadym Davydenko, describing the agency’s position as “absolutely farcical”.
The criticism was directed not at the criminal proceedings themselves, but at what appears to be a lengthy and costly legal process that has brought the child protection system full circle.
The young man entered Tusla’s care last year after the agency assessed him as a child and successfully sought an interim care order. However, concerns later emerged regarding his age.
In January, District Court Judge John Campbell refused to extend the care order, stating that he did not believe the young man was a child. Tusla challenged that decision in the High Court and succeeded in having it overturned. 
The agency then conducted a second assessment of its own, only to conclude that the young man was in fact over 18, effectively arriving at the same position previously reached by the District Court judge.
Despite this reversal, Tusla has continued to pursue a formal age inquiry under the Child Care Act.
Judge Conor Fottrell questioned the purpose of continuing the proceedings when the inquiry is not expected to conclude until June 18th and the young man, according to the dates he provided when seeking asylum, will turn 18 on June 20th.
The judge described the situation as “highly unusual”, “unrealistic” and “unfair”, observing that the court was being asked to determine whether a person was entitled to child protection services only days before he would age out of the care system.
Counsel for the young man argued that the proceedings were approaching the point of futility. She questioned whether the court was effectively being asked to decide whether he was entitled to Tusla services for just two final days before reaching adulthood.
The case illustrates a broader concern that has surfaced in a number of child protection proceedings in recent years. Delays in assessments, reviews, legal challenges and court hearings can result in significant amounts of time, money and professional resources being devoted to disputes whose practical consequences have largely disappeared by the time a decision is finally reached.
Throughout the process, Tusla has maintained that it is legally obliged to follow the statutory procedures and ensure fair process for the young person. However, Judge Fottrell’s remarks suggest frustration with a system that spent months contesting a judicial finding, only to ultimately arrive at the same conclusion itself.
The financial dimension is also difficult to ignore. While no figure was given in court, the costs associated with multiple hearings in the District Court, a High Court judicial review, legal representation for all parties, expert assessments and ongoing care arrangements are likely to be substantial.
Those costs are ultimately borne by the taxpayer. Against that backdrop, the judge’s description of the process as “farcical” reflects a wider concern about whether public resources are being used effectively when lengthy legal proceedings end up resolving a question that has little practical significance by the time the answer arrives.

Minister Foley was asked a question about RTÉ & Children’s Books Ireland promoting “What’s the Tea?” a book aimed at under 16s that gives graphic instructions on anal sex, douching, and other explicit sex acts.
Her response? “I do not know that book.” Followed by the usual line “parents should supervise.”
That is not leadership. This is wiping her hands of responsibility.
As Minister for Children, Foley has a duty to protect children from inappropriate, sexually explicit material being pushed by state funded organisations and schools.
Parents already bear the brunt of safeguarding in a culture that sexualises children early. Taxpayer-funded RTÉ should not be accelerating that.
Minister Foley’s dept funds and oversees much of this space. Claiming ignorance after being notified, then refusing to condemn the content as unsuitable, signals that ideology matters more than child protection.
Do. Your. Job. Minister Foley.

Tomorrow some of the MLHR team are heading to Appleby Uk, one of the largest horse fairs. Different groups of us will be travelling across to the UK, with the first team leaving at first light. We will search every corner, every road, every field, every place we can. If Eleanor is there, we will find her.

The support has been incredible, and it is helping us keep going through what feels like our darkest days💔
The truth is that we are devastated. We haven't slept. We are exhausted, heartbroken, and terrified. Eleanor is not just an animal to us, she is family. All we want is our girl home where she belongs.
We have been incredibly fortunate that three kind hearted people have pledged an additional €1,000 reward towards Eleanor's safe return. Their generosity means more than words can ever express.
At the same time, we are facing huge costs. We are now arranging round the clock volunteer patrols, improving security, and trying to secure fencing around our perimeter to help prevent anything like this from ever happening again.

That @RTE’s Kids Book Club is promoting a “Read with Pride” list that includes books giving explicit sexual instructions to under 16s shows how much we need to be rid of that

From the below report it seems RTÉ, Ireland’s state broadcaster, and Children’s Books Ireland (a state-funded national charity) are actively promoting the 'Read with Pride 2026' guide to children and teenagers as young as 15. One of the books they recommend, 'What’s the T?', contains explicit, step-by-step instructions on how to perform anal sex, including advice on lubrication, douching, and other sexual acts. Let me be crystal clear about what this actually means under Irish law. The age of consent in Ireland is 17. Full stop. Under Section 17 of the Criminal Law (Sexual Offences) Act 2017, it is a criminal offence for any person to engage in a 'sexual act' with a child under 17. 'Sexual act' is explicitly defined to include anal penetration. Consent is completely irrelevant. A 15-year-old cannot legally consent to any sexual activity – vaginal, oral or anal. If the act takes place, the older person is committing the offence of defilement of a child / sexual act with a child. There is a very narrow “close-in-age” defence only if the accused is less than two years older than the 15-year-old and the relationship is not exploitative. Anyone older than that has no legal defence. In plain English: if a 15-year-old follows the instructions in the book RTÉ & Children’s Books Ireland are pushing, & has anal sex with someone outside that tiny exemption, the person having sex with them is committing a serious criminal offence; what the public rightly calls statutory rape. This is not 'inclusion. This is not 'education'. This is state-linked & funded organisations normalising & providing how-to guidance on sexual acts that are *illegal* when carried out with children under 17. If it's not technically grooming, it's its next door neighbour. Taxpayers and TV Licence payers are funding this. RTÉ is broadcasting it. Children’s Books Ireland, which receives public money, is publishing the list. The Government cannot pretend this has nothing to do with them. When the state broadcaster and a state-funded body promote material that, if acted upon by its stated target audience, minors, would involve the commission of a sexual offence against that minor, it is a matter of the utmost public concern. Parents have a right to know. The Oireachtas has a duty to act. And the Minister responsible cannot simply shrug and say “parents should decide”. This has to stop. Defend the innocence of our children.
